Ten Considerations for your Company Doctor

When looking for a company doctor, employers need to consider the following attributes to achieve the best maximum care for injured employees. Your company physician will:

 

1.  Be responsive to your employees' needs and willing to return employees to the workplace as soon as possible.

2.   Visit your company, become familiar with your operation, and observe the jobs being performed.

3.  Schedule your employees' appointments immediately, without delay, and is flexible in scheduling appointments.

4.  Spend extra time with your injured employees, as needed.

5.  Review your job descriptions and use your forms for transitional duty accommodations.

6.  Provide medical records/reports (if allowed by law) to the insurance company claims adjuster or to you as needed in a timely fashion.

As a risk manager or someone involved in the claims process, be ready for the onslaught of the consequences of layoffs or downsizing.  Not everyone will file a claim for workers comp, but bet the disgruntled employees will, along with a few unexpected employees to now report an injury of some sort in the past. How are these issues controlled and handled proactively? 

When a worker is injured, there is no way to tell of the past medical injury. Typically the common causes of a delay in accepting or denying a workers comp claim will have do to with the adjuster trying to locate past medical records. Here are some tips to try to speed up the process. 

One of the least understood types of workers compensation claims is the psychiatric injury claim. Employers understand the physical injuries like a bone fracture or a laceration, but the mental injury claim is more difficult for employers to accept as a workers compensation claim.  With the psychiatric claim there are often no objective physical findings that can be measured. California Fraud Case Manuel Perales, 50, of Fontana, Calif., has been charged with two counts of workers compensation insurance fraud, according to the San Bernardino County District, and A Cleveland woman was sentenced recently for fraud after Ohio BWC investigators found she was working for a veterinary hospital and a local charity while receiving benefits for a workplace injury.

The Florida Department of Financial Services Division of Insurance Fraud reports that it has charged an Orlando man with workers compensation fraud and grand theft after an investigation claimed he fraudulently collected more than $115,000 in benefits.

OSHA's Houston South Area Office initiated a safety inspection following a complaint alleging that several employees had suffered near amputation incidents while operating machinery. The investigation found many issues and violations. Read on. 

"Employees should be free to exercise their rights under the law without fear of termination or retaliation by their employers," said Gregory Baxter, OSHA's regional administrator in Denver. "This lawsuit underscores the Labor Department's commitment to vigorously take action to protect those rights."
