ACHIEVING SUCCESS TIPS
Eleven Reasons NOT to Select a Doctor

Rule out doctors with these attributes as they will NOT put your best interests (or those of your injured employees) first. Doctors who:

  1. Are biased or sides with either the injured worker or the company.
  2. Are known as being "claimant-oriented."
  3. Routinely prescribe periods of time out of work despite the nature of the illness.
  4. Don't give enough detail about present work capacity to enable employers to place employees in transitional duty positions.
  5. Often recommend surgery before more conservative treatment.
  6. Are not excited about working with your company or condescending when speaking with you.
  7. Are out of the office frequently or fail to respond quickly to your phone calls or emails.
  8. Cannot or are unable to schedule last-minute appointments with your injured workers.
  9. Order excessive physical therapy.
  10. Don't have a good reputation in the community.
  11. Have a poor bedside manner.

With each state having its own unique way of doing things, finding specific information can be daunting. Spend hundreds of fruitless and frustrating hours searching, or let us do the work for you!

This week, the NY Court of Appeals issued a major decision on RTW. It also issued a decision, Schmidt v Falls Dodge, Inc, 2012  NY Slip Op 03359, which will receive little attention, but carries powerful potential. More from Attorney Ted Ronca.

A decision issued this week, "Zamora v Neurologic Assn.", has removed a presumption that people no longer working after an accident were presumptively disabled by the accident. What impact does this have?

Currently, the Board accepts NY specific claims information from employers and insurance carriers through paper submission. Beginning in early 2013, things will change.

Cal/OSHA launched the statewide campaign in February, citing seven *preventable* confined space deaths and numerous injuries in the state in 2011.

The court actions are the result of investigations conducted by BWC's Special Investigations Department, which works to deter, detect, investigate, and prosecute workers comp fraud.
