ACS BILLS STALL IN STATE HOUSE OF REPRESENTATIVES

 

At press time, the ACS bills had stalled in the State House of Representatives. The first bill, SB 1454, would lower copays for chiropractic care from specialist to PCP levels. We have searched for a vehicle bill to attach our bill to but have failed to find one. It appears the bill may be dead for the session.

 

The same appears true for our second bill, SB 1075. This bill would require the Arizona Department of Insurance (ADOI) to take enforcement action whenever there is a violation of the insurance equality law. It would also require that fees paid to chiropractors be the same as they are to MDs and DOs for the same service. This bill would also modify the insurance equality law so that chiropractors could no longer be singled out for utilization review.

 

Because this bill would affect one of the Governor's agencies, the Senate President wanted to see how the Governor felt about the bill before allowing a hearing in the Senate. Therefore, we had a meeting with the Governor's staff to discuss the matter. They indicated that they would need to meet with the Department of Insurance to get their input and that meeting has not yet happened. In the meantime, the deadline to hear bills in the Senate expired. Now the Governor's office has indicated they will not have the time to meet with the Department of Insurance until the session is over. Therefore, this bill appears to be dead for the session.

GRIEVANCE LETTERS - THE BEST TOOL TO GET INSURERS TO PAY

 

When insurers do not pay, the single best tool to use is called a "Grievance Letter" which was enacted into law in 2000 through the efforts of ACS among others.

 

Each insurer must have a written grievance policy that is available to providers upon request. Each insurer must designate a contact person (the "Grievance Officer") to receive grievances and answer provider questions on those grievances. Insurers may recommend, but may not require, a specific form for the submission of grievances. Insurers must file semi-annual grievance reports to the Department which include information such as the number of grievances received by an insurer, the kinds of grievances, and the time to resolution. If the Department is not pleased with what it sees, it will audit the insurer with a Market Conduct Evaluation.

 

Basically what a Grievance Letter does better than any other approach is to get serious attention from the insurer. This is because the insurer must report on a semi-annual basis to the Arizona Department of Insurance (ADOI) how all of the provider grievances were handled. For example, were the majority of the grievances decided in favor of the providers or the insurer? If ADOI finds that the providers' grievances are not being sufficiently considered by the insurer, then ADOI can order an audit. ADOI sends personnel to the insurer to go through their books and assess fines if appropriate. No insurer wants to go through that process and so they take Grievance Letters very seriously, much more so than the usual letters and calls they receive on a daily basis. 

 

We call the Grievance Letter an "arrow through the heart." We strongly recommend using it whenever appropriate. Please don't be intimidated by the title of the letter. It is basically the same as the usual insurance complaint letter, simply addressed and mailed to a different person at the insurance company (the "Grievance Officer").    

 

To find the name of the Grievance Officer, ask the insurance company representative you are working with on the claim. If they don't know the answer, ask to speak with a supervisor. If all efforts fail, you can get the name of the Grievance Officer from the Arizona Department of Insurance. You can call the Life and Health Division at 602-364-2394 and ask for Audrey Franklin or one of her assistants, or you can email your request to providerinfo@azinsurance.gov. Finally, be certain to send a copy of your grievance letter to Audrey Franklin.

HEALTH CARE APPEALS PROCESS

 

Arizona has a legal Health Care Appeals Process that all insurers must follow. For denial of standard services or claims (as compared to urgently needed services not yet provided), here are the steps to follow:

 

1. Informal Reconsideration: Within two years after a claims denial, you may call, write or fax a request for an Informal Reconsideration to the insurer. The insurer has 30 days to respond.

 

2. Formal Appeal: If the insurer denies the Informal Reconsideration, you may file a Formal Appeal. You have 60 days following the completion of the formal Reconsideration of a denied service to request a Formal Appeal. The insurer has 60 days to make its decision.

 

3. External Independent Review: You have 30 days after the insurer notifies you that your Formal Appeal was denied to request an External Independent Review. Your insurer will send a copy of all relevant medical records, your request for review, the insurance policy and any supporting documentation used to make its earlier decision to the Department of Insurance within five business days of receiving your External Independent Review request.

 

For medical necessity cases, the Department will forward all materials to an independent review organization selected by the Department within five business days of receiving them. The reviewing organization in not connected to the insurer. The reviewer has 21 days to notify the Department of its decision. 

 

The Department then has 5 business days from when it receives the reviewer's decision to notify the patient, the doctor and the insurer of the decision. The insurer pays the full cost for the independent external review even if the final decision favors the insurer's position.

 

The external independent reviewer's decision is legally binding on the insurer and the policy holder. Either party may go to court if there is still a dispute regarding medical necessity.

The Health Care Appeals system does not apply to coverage through Medicare HMOs, multi-employer plans under ERISA, federal employee plans, any self-insured plans or workers' compensation plans.

 

 

HOW TO FILE A COMPLAINT AGAINST AN INSURANCE COMPANY

INSTRUCTIONS

 

1. Go to the webpage of the Arizona Department of Insurance (ADOI) entitled "Consumer Assistance: How to file a complaint." Click here: http://www.id.state.az.us/consumerassistance.html

 

2. Click on the button for Third Party Consent Form. Download, and print this form. Then have your patient complete and sign it so that you can file the complaint on behalf of your patient. 

 

3. Click on the button for Complaint Form. Complete the form online, print it, and mail it to ADOI at the address listed on the form. Be sure to also send in copies of any letters, notices, receipts or other documents supporting your complaint.

 

EXAMPLES

 

1. Failure of an insurance company to answer your phone calls regarding coverage or other issues.

 

2. Failure by an insurer to include any chiropractors in the PPO and failure to pay all chiropractic claims at the in-network rate when there are no chiropractors in the PPO.

 

3. Failure to pay a claim within 30 days of submission.

 

4. Claims indefinitely put on "pending" status with no reason given.

 

5. Failure to cover all reasonable and necessary chiropractic care.

 

6. Claiming that the damage to a patient's vehicle was too minor to cause injury without "genuine reliance" on medical records. This is a violation of ADOI Circular Letter 2000-2.

 

7. Any improper insurance company practice.
