ACS LOBBYIST STORMS THE LEGISLATURE
ACS lobbyist Debra Brimhall Pearson has stormed the Legislature with scores of meetings with legislators and key staff members. She is explaining to them that our insurance equality law must be move away from the jurisdiction of the Arizona Department of Insurance (ADOI) so that it can be enforced, and that a bill must be passed to lower chiropractic copays from specialist to PCP levels. You will recall that the courts ruled that ADOI has no duty to enforce the chiropractic insurance equality law even if there are violations, and we have found that ADOI has misinterpreted the law and refused to enforce it. We must move the law to a separate section of the insurance code so that any policyholder or doctor who has had the policy rights assigned to him or her can take legal action to enforce the law. Also, we must lower copays for chiropractic care from specialist to PCP levels.
Even before the November elections, Debra Pearson has had multiple meetings with key legislators and staff members on these issues. After the elections, the pace of the meetings will pick up. Debra has vowed to meet with each of the 90 legislators before the session begins. We plan to be in a strong position when the Legislature convenes in early January, 2015. You will be called upon to contact your legislators to ask them to support our bills when the time comes.

STATUS OF PENDING LAWSUITS
The lawsuit against BCBS and ASHN is still pending an opinion from Attorney Brian Hufford who filed the lawsuit against CIGNA and ASHN on behalf of the ACA. Mr. Hufford has also filed a number of other lawsuits on behalf of chiropractors and state associations and so has tremendous experience. We have decided to consult with him to make sure we are doing things in exactly the right way. He is extremely busy and so this has caused some delay.
The Sec. 2706 lawsuit against United HealthCare is also still pending because we have not yet found sufficient plaintiffs willing to participate. If you have UHC patients who would be willing to be plaintiffs, have them contact ACS immediately. There may be financial compensation for participation. This lawsuit will allege that UHC pays chiropractors less than they pay other providers for delivering the same services. We have documentation showing that UHC pays nurse practitioners more than they pay DCs for the same services. Now all that we need are plaintiffs.

CHIROPRACTIC BOARD LISTS APPROVED COURSES ONLINE Two Hours of Courses in Record Keeping Required for 2014
The Chiropractic Board has a list online of all approved continuing education courses available at http://www.azchiroboard.us/Approvedcourselist.pdf. There is a wide range of in-person and online courses available. Bear in mind that for 2014, you must take at least two hours of courses in record keeping. There are two courses available online for two hours in record keeping to meet the requirement. They are user-friendly and easy to take. Be sure to take your CE courses from the Board-approved list in order to stay in compliance.

THE CONSEQUENCES TO ONE DOCTOR FOR ROUTINELY WAIVING COPAYMENTS AND DEDUCTIBLES
One ACS member recently received the following correspondence from Aetna on behalf of a large self-insured employer after they learned he was routinely waiving copayments and deductibles. This is not rare and so you can expect the same if you are following this practice in your office.
Dear Dr. John Doe:
After contacting some of your patients, it has come to our attention that you routinely waive all patient responsibility ( co-insurance & deductibles ) for which our members are normally responsible.
By waiving all patient responsibility, you have effectively reduced the amounts of your bills and therefore reduced the amounts that our members would be legally responsible to pay in the absence of their insurance coverage.
We favor price competition that benefits the consumer and helps hold down the cost of health care. We encourage providers to offer discounts for services rendered when the discounts are clearly indicated on the patients' statements of claims. In those cases, we adhere to our contract and pay only our portions of the bills. Failure to disclose such discounts can be interpreted as a deliberate effort to deceive the payor.
We request that you provide us, in writing, with your position concerning the waiver of all patient responsibility ( co-insurance & deductibles ). We also request that you clearly indicate any discounts on future claim submissions. Please complete the questionnaire provided with this letter, sign and date it, and fax your response to my attention to 888-888-8888 by October 31, 2014.
Following your written confirmation of routine waivers and/or if we don't hear from you by October 31, 2014, we will adjudicate your claims as if the amounts billed reflect reductions in members' responsibilities, i.e., bills that are, in fact, lower than the amounts you are presenting. As such, the amounts billed will be reduced by the applicable co-insurance for each member. The resulting amounts will then be used as the billed amounts and claims processed based on those figures.
In addition, since you failed to indicate the waivers on your claim submissions, we may be requesting reimbursement of the difference between the payments made to you and the
payments that would have been made, had the waiver of the co-insurance assessments been indicated. In general, co-insurance assigns an additional 20% to the members' total responsibilities. Upon the completion of our investigation, we will provide you with a letter detailing the amount of the overpayment and any additional findings, if applicable.
Please call me at the above number should you have any additional questions or concerns. Thank you for your cooperation in this matter.

CAN DELTA V PREDICT INJURY LIKELIHOOD OR SEVERITY
Can Delta V predict injury likelihood or severity? In a word, no. Delta V is the change in velocity. If you are stopped at a red light going zero miles per hour and hit from behind, your vehicle may be accelerated to 10 mph. You have gone from zero to ten mph and so your change in velocity or Delta V is 10 mph. Delta V is a key value in PI cases.
Engineer Siegmund, an authority cited by most defense engineers, lists 13 factors that must be taken into account when predicting injury likelihood and severity, and Delta V is only one. . .
Another scientific peer-reviewed published journal article concluded that in order to predict injury likelihood and severity, one would need to know information about the individual's tissue strength and elasticity and "any multitude of variables that evade accurate determination" along with the Delta V." Four key journal articles from the peer-reviewed scientific literature reflect the general consensus of the clinical biomechanical and accident reconstruction communities. The journal studies and their noted conclusions are supported by numerous references cited by the authors. The conclusions drawn by these multiple authors were approved by the independent peer-reviewers and have achieved general consensus in the scientific community. They prove that the modern peer-reviewed scientific literature supports the position that one cannot calculate Delta V and then predict injury likelihood or severity. In order to further understand why Delta V cannot be used alone to predict presence or absence of injury in an individual, it is important to understand the difference between predicting an injury outcome in the general population and in an individual. While it may be correct to state, for example, that a 5 mph Delta V rear impact collision will only result in a significant injury in 1 in 100 individuals, this low probability of injury is unrelated to the actual result of the crash in an individual, as they may very well be the one in 100 who was injured . . . Defense engineers generally place no weight on medical records, not surprising since engineers have no medical education and thus no ability to read and comprehend medical records. A case file might include records from multiple doctors documenting objective evidence of injury immediately following the subject trauma but all such records are dismissed as irrelevant by the engineer. This denial of medical reality has been legally banned in Arizona which requires "genuine reliance" on medical records in all biomechanical/accident reconstruction analyses . . . BOARD ACTION ALERT
Doctors so far this year, 45 DC's have had complaints opened for failure to properly report their CAs and their training. Receiving a letter from the chiropractic board can be very stressful and costly. This type of board complaint is completely avoidable. The laws and rules in AZ are quite clear on the time frames required for reporting and training you're CA. The rules are that you, the DC needs to notify the board that you have hired an assistant within 7 days, on a board approved form. The assistant needs to start their training with a board approved training company within 90 days of hire. As the DC you are responsible to ensure that they complete their training within one year of their initial hire date. The DC is responsible to report on a board approved form, the dates and hours of the assistant's coursework, to the AZBCE.
