SENATOR NANCY BARTO NAMED 2014 LEGISLATOR OF THE YEAR
Plans for 2015 Legislative Session Unveiled
Senator Nancy Barto, representing Northeast Phoenix, has been named the 2014 chiropractor legislator of the year. She was the prime sponsor of all of the chiropractic bills last session including the bill to make copays for chiropractic care the same as they are for PCPs, the bill to make the chiropractic insurance equality law enforceable, and the bill to add chiropractic to AHCCCS. But she didn't just sponsor these bills and sit back to see what happened. She worked hard on these bills all the way to the end of the session to try to get them passed and very nearly succeeded, thus laying the groundwork for a successful session beginning in January, 2015. In January, 2015, ACS will work hard again to pass a copay bill to make copays for chiropractic care the same as they are for PCPs. We would have passed committee and had a vote by the full Senate if one Senator had not be absent on a crucial day. We will also be working hard again to pass legislation to make our insurance equality law enforceable. Right now, the courts have ruled that the Arizona Department of Insurance (ADOI) does not have to enforce the law even if there are clear violations. This must not stand and ACS will fight hard to overturn it.
Of note is the fact that the AAC is not working on either of the above-described bills. They have decided to work on an AHCCCS bill that requires referral from an MD or DO before a DC can be seen. The Legislature put a price tag of $1 million on this bill which averages out to about $500 for every Arizona DC. In sharp contrast, if the ACS bills pass and health insurance funds begin to flow again, it is estimated that $100 million would be released to Arizona chiropractors, an average of $60,000 per DC. You can see why ACS has set its priorities of copay and insurance equality legislation first and AHCCCS legislation second.

REAL RELIEF WILL COME FROM PENDING LAWSUITS
Lawsuits which will soon be filed will provide needed relief for Arizona chiropractors. There are two lawsuits pending. The first is based on Section 2706 of the federal Affordable Care Act, aka Obamacare, which requires that payments to DCs for specific services be the same as they are to MDs and DOs unless there are differences in performance or quality measures which there are not. For example, DCs get paid by ASHN $18 for all physical medicine services per visit whereas MDs and DOs get paid 3-4 times more. This is clearly illegal according to our attorneys. A lawsuit will be filed over the disparities dating back to 01/01/14. Doctors will be paid retroactively for the difference in payment amounts and for the future the payments will increase. Payment per visit could increase by up to $50 per visit.
The second lawsuit will challenge the right to perform precertification since the requirement for precertification is not being applied equally to MDs, DOs and DCs. The lawsuit will also challenge the ASHN tiering system since patients get different amounts of care depending on the tier level their chiropractor is in. Many other aspects of the ASHN structure will be challenged. This will be a class action lawsuit and so your practice will be covered. No more illusory benefit where BCBS claims it covers chiropractic but then only pays $4 out of a $44 visit, a total of 9% paid by the insurer. This is not insurance coverage when the insurer only pays 9% of the cost of the visit and the patient pays 91%. It is consumer fraud.
These class action lawsuits will start out with one DC and one BCBS policyholder and we have each in place, ready to go. The lawsuit documents are being finalized at this time. Expect the lawsuits to be filed in the near future and then relief will be in sight. This has been a gargantuan undertaking considering the research necessary and the need to supply the attorneys with all needed BCBS and ASHN documents. Many doctors have helped from across the state and we are most grateful for their help and time. It will now pay off. If you have any questions about the lawsuits, be sure to contact ACS. We are the only state association willing to file lawsuits to solve the profession's problems with the AAC vowing never to follow this route for unexplained reasons. It appears they do not want to disrupt their friendships with the insurance companies. From the ACS perspective, we are not friends with those who would destroy our profession.
Historically, lawsuits have made a huge difference for chiropractors. Think back to Wilk v. AMA where Charles Wilk, DC and 5 DCs sued the AMA in the late 1970s alleging antitrust lawsuits. The lawsuit was finally won in 1989 and as a result you can now work with MDs in your practice and the AMA no longer works to eliminate the chiropractic profession. The lawsuits planned by ACS will have just as powerful an impact. They are not easy to create and file but we are pursuing this route nonetheless. We have the best attorneys in country on our side and so are confident the lawsuits will be filed and ultimately won.

PROFESSION DELIGHTED ACS HAS REHIRED DEBRA BRIMHALL PEARSON AS LOBBYIST
The profession has expressed great delight over ACS' decision to rehire Debra Brimhall Pearson as its legislative lobbyist. Debra worked for ACS for about five years in the mid-2000s and then took a break to run her family business and pursue a master's degree and doctorate and now is available to work for ACS again. Doctors who were members in the mid-2000s remember the incredible energy and passion that Debra brought to the job. For Debra, it was not a job, it was a calling. Debra literally has more faith and confidence in chiropractic than most chiropractors and firmly believes that chiropractic must thrive and grow. PERSONAL INJURY CASES: LaBOMBARD COMMON FUND DOCTRINE DEMANDS TO REDUCE YOUR BILLS BY ONE-THIRD

URGE YOUR MEMBER OF CONGRESS TO SIGN ONTO SCHRADER LETTER
The Patient Protection and Affordable Care Act (PPACA) contains a variety of important consumer-oriented provisions, one of which is Section 2706 (non-discrimination in health care) that is intended to prevent insurance industry discrimination against whole types of licensed and certified health care professionals, a practice which has the practical effect of denying patients their ability to choose the health care provider of their choice for the treatment of covered services.
Unfortunately, Section 2706 is in danger of being undermined and watered down, due to the behind-the-scenes influence of the insurance industry and others, who are working hard to influence HHS in a way that would eviscerate the provision and to prevent its implementation as intended by the drafters of the law.
To help ensure the appropriate implementation of Section 2706, we are urging your Member of Congress to sign onto an important "Dear Colleague Letter" on this issue. The signed letter will then be directed to the Secretary of HHS and the Obama Administration.

TOXIN OVERLOAD: "TOXEMIA"
Toxin or poison overload, called "toxemia," is an age-old concept that you must understand to protect your health. Many health problems come from toxemia.
Toxemia results from accumulation in the body of chemicals which are toxic in any amount, or chemicals which are not toxic in normal amounts but become toxic when they are present in excessive amounts. Toxic chemicals inflict damage on the body.
Chemicals which are toxic when present in any amount include arsenic, lead, lye, mercury, asbestos, botulism poison, etc. These chemicals will cause severe illness. Lead poisoning from eating paint chips, for example, causes severe brain damage.
Chemicals which are not toxic when present in normal amounts but which become toxic when present in excessive amounts may cause severe illness. To understand this picture the body as a funnel with food being poured into the larger opening. There are only three things the body can do with the food: burn it for energy, use it for building blocks, or eliminate it via the intestines, kidneys, lungs, skin and other routes. But, as represented by the smaller end of the funnel, the body has only a limited capacity to process foods.
The body makes hundreds of changes to the food between the top and the bottom of the funnel. Chemical A is converted to chemical B which is converted into chemical C, then D, then E, etc. When you eat too much the funnel gets overloaded causing a backup. The result is a great increase in the amounts of all body chemicals (A, B, C, D E, etc.) known as "intermediary metabolites" (IM's) Many of these chemicals are known to be toxic when present in excessive amounts, and they frequently cause illness.
For example, it is well known that IM's accelerate the aging process by causing the development of cross linkages between protein molecules. Cross linkages cause joint stiffness, wrinkling and overall deterioration of the body.
Biochemists are very familiar with some of the most common IM's such as pyruvic acid, malic acid, fumaric acid, and alpha ketoglutaric acid. These chemicals are known to be disease producing when present in excessive amounts. Eating more food than your body can handle causes a buildup of such chemicals which results in damage to the body.
Hundreds of scientific studies have shown that eating a relatively small amount of food will delay aging. This is because the body is able to completely process all of the food when less is eaten so there is no buildup of the IM's which speed up the aging process.
There are many other normal body chemicals which cause disease when present in excessive amounts. Cholesterol is one of the most famous. It is needed to form chemicals to assist digestion and absorption of fats, manufacture many hormones which regulate body function, and construct the membranes which enclose all body cells. Dietary sources of cholesterol are meats, dairy products, and eggs. If excessive amounts of these foods are eaten the blood cholesterol level will soar and the risk of a heart attack or stroke will increase.
Triglycerides are the fats in food and in the bloodstream. They are an important source of energy for the body. Triglycerides come from the saturated fats in animal foods, the unsaturated fats in vegetable foods and from sugars and starches via conversion in the liver. An elevated triglyceride level makes the blood cells become sticky and clump together. This reduces blood flow and can cause a heart attack, stroke or other serious problem.
Uric acid is another chemical which is normally present in the bloodstream. It comes from eating meats, drinking alcohol, breakdown of body tissue and production within the body. High levels of uric acid in the bloodstream will cause a serious form of arthritis called gout.
Glucose is blood sugar. It comes from the breakdown of starch and sugar, or conversion from fat and protein. An elevated level of glucose causes a corresponding increase in the level of insulin. The result is damage to the blood vessels, nervous system, muscles and eyes. This damage can cause a heart attack, stroke, numbness, weakness, impotence, cataract and blindness.
Homocysteine is a chemical that comes from the breakdown of protein. The walls of blood vessels will become irritated if blood levels of homocysteine become too high from eating too much protein. Such irritation leads to the buildup of fat deposits which can cause a heart attack or stroke.
There is no question that you must understand toxemia to protect and improve your health. The concept of toxemia was developed in the early 20th century by John H. Tilden, M.D. He stated that stress from daily habits or from the environment will excessively strain the body. This strain will affect both the mind and the body and lead to overall exhaustion which Tilden called enervation. When enervation develops, the body becomes too weak to efficiently eliminate toxins of any type through the liver, lungs, intestines, kidneys, or skin.
Inefficient elimination leads to retention of toxins. Toxemia develops when there is an excessive accumulation of normal or abnormal chemicals.
A continual rise in toxin levels will inevitably exceed the body's level of tolerance. , The body will attempt to eliminate the toxins when the point of intolerance is reached. Symptoms of elimination include sneezing, coughing, vomiting, diarrhea, skin secretions and dark urine. These symptoms are evidence of a health building process and should be welcomed as evidence of vigorous healing.
The body may not have the strength to do an effective job of cleansing and elimination if it has been overwhelmed for years with toxins. Chronic illnesses develop when toxins are present for a long time. One common example is heart disease from a buildup of cholesterol.
Advanced toxemia will irritate all areas of the body. Some parts of the body are weaker than other parts because of heredity or previous health problems. The weaker parts will show signs of disease first. The same toxins may cause a lung problem in one person but a kidney problem in another.
Dr. Tilden discovered many causes of enervation and toxemia. Nutritional causes include overeating, eating the wrong foods, vitamin and mineral deficiencies, use of coffee, tea or alcohol. Emotional causes include worry, jealousy, rage and fear. Miscellaneous causes include toxins produced by bacteria, an unfriendly environment, injuries, postural tension, physical defects, physical excesses and the unpoised state.
The solution for toxemia is to support the body as it attempts to solve the problem. The body does not need to be actively cleansed by laxatives, enemas or similar measures since it is fully capable of cleansing itself. We should stop fighting the body when it tries to eliminate toxins through coughing, diarrhea and other means of elimination. Taking drugs to stop the mucous flow of a cold or to stop diarrhea will stop the necessary and health building elimination of toxins from the body.
The only time to take drugs is the rare occasion when the intensity of the elimination process itself becomes life threatening. For example, a child with severe diarrhea lasting for more than two days can become dehydrated and die without drugs. An elderly patient with a severe cough from pneumonia could also die without drugs. But, these are the rare exceptions to the general rule that it is safe to weather the storm of an elimination crisis without taking drugs. It is best to have a knowledgeable doctor supervising your care.
When the body is permitted to complete the elimination then the toxins will be flushed from the body. Great health simply springs forward when the burden of toxemia is lifted.
