ACS SCORES GREAT VICTORY AS SENATE HEALTH COMMITTEE CHAIR AGREES TO SPONSOR ACS INSURANCE EQUALITY AND COPAY BILLS

 

ACS has secured the best possible sponsor for its bills ever in 2014, Senator Nancy Barto, Chairwoman of the Senate Health and Human Services Committee. Other Senators look to the Senate Health Committee Chair for leadership on all health and insurance issues and so will be far more likely to vote for the ACS bills with Sen. Barto as prime sponsor. There will be multiple other leading legislators including past prime sponsor Sen. Rick Murphy who will be cosponsors, but having Sen. Barto as prime sponsor is a huge victory for the profession. This is the first time in history that the Chair of the Senate Health Committee has agreed to sponsor chiropractic insurance equality legislation and is the outcome of literally years of lobbying work. Sen. Barto is extremely well respected as a principled, honest, hardworking legislator at the Capitol.

 

The Arizona Legislature will begin its new session January 13, 2014 and ACS will be ready with two new bills for chiropractic. The first will move the existing chiropractic insurance equality law to another section of the insurance laws so that any policyholder can take private legal action if the law is violated. It will then not be necessary to depend on the Arizona Department of Insurance (ADOI) to take enforcement action when there are violations. This is necessary since ADOI has shown time and again that it is unwilling to act even when there are clear and obvious violations of the law, and the courts have refused to force ADOI to act after lengthy litigation funded by ACS.

 

The second bill will require that copayments for chiropractic care be set at the same level as they are for primary care physicians. The difference this year is that the bill will cover not only chiropractors but also physical therapist, occupational therapists and respiratory therapists. This will eliminate the argument that DCs are trying to use the bill to expand the scope of practice to equal that of a PCP. The feedback we have received is that this change will greatly increase our chances for success.

 

ACS has released its 2014 Legislative Information Proposal and Documentation Part One  and Two. We request that all legislators read this vital document in anticipation of meeting with our lobbyists, doctors and patients. Your involvement, as always, will be essential to ensure passage of these bills. You will be called upon to email and call legislators at critical times when the bills are scheduled for votes in committees and by the full Senate and House. Stay tuned to your emails and be prepared to act swiftly and aggressively. The insurers have the edge over us in terms of numbers of high priced lobbyists, but we have the edge in terms of numbers of grassroots supporters who can generate tons of emails and calls from around the state. We have only won in the past because of such grassroots efforts. ACS will keep you informed every step of the way throughout the Legislative process.

 

What can you do now? Click on this link: How Do I Find My Legislators and enter your home address to find your Legislative, not Congressional, district. Then find the link for the Arizona Legislature at www.azleg.gov. Go to the House then to Members and search for your District number and find your two House members. Do the same for the Senate and Members and find your Senator. Send them both parts of the ACS 2014 Legislative Information Proposal and Documentation package with a simple cover letter along the lines of the following:

 

"Dear Representative (or Senator) X (fill in the name): I respectfully request that you take the time to read the attached information regarding upcoming chiropractic legislation for 2014. All that we are asking is to be treated the same as MDs and DOs when it comes to treatment of common back and neck conditions. If an insurance company covers all medically necessary treatment performed by MDs and DOs for these conditions, then this legislation would require coverage of all medically necessary treatment performed by chiropractors for these conditions. Patients want and deserve medical freedom of choice so that they can choose the type of treatment they want to use their health insurance to cover. These bills would accomplish this purpose. The prime sponsor is Senate Health Committee Chair Nancy Barto. I would respectfully ask you to consider being a cosponsor of the bills. In the meantime, I would greatly appreciate it if you would read these materials to learn the facts about how chiropractic truly is clinically effective and cost effective for treatment of common spinal conditions, and how we have been suppressed by our economic competitors in the medical profession. I thank you for your attention to this very important issue. Yours truly, Dr. Y (fill in your name)."

CLASSACTION

CLASS ACTION LAW SUIT AGAINST BCBS AND

ASHN STILL UNDER DEVELOPMENT

 

ACS announced last month that the Phoenix class action law firm, Bonnett, Fairbourn, Friedman & Balint, PC, is very busy evaluating potential class action claims against BCBS and ASHN by doctors and patients affected by the insurance companies' abusive practices relating to chiropractic care. On the firm's webpage at http://www.bffb.com/, you can read at length about the cases this firm has successfully prosecuted against the largest corporations in the U.S. over the past decades. The lead attorney for our case is Andrew S. Friedman, known nationally as one of the foremost class action attorneys in the country. He heads the firm's class action, securities fraud, and consumer fraud practice groups.

 

Another month has passed and ACS remains extremely optimistic that Mr. Friedman's law firm will file a class action lawsuit against BCBS and ASHN in Arizona. It is taking time for the plaintiff chiropractor and BCBS policyholder to assemble all required documents needed to draft the lawsuit documents. The list of documents is quite long. Be assured, however, that the work is being done and eventually will be completed. Stay tuned since this will be one of the most powerful actions ever taken by ACS to achieve insurance equality.


ACS has a long history of only retaining the best of the best when it comes to legal counsel. Attorney David Abney who handled the lawsuit against the Arizona Department of Insurance (ADOI) is considered the best appellate attorney in Arizona. The ACS health care lawyer, Jerry Gaffaney, is considered one of the five best in the state. ACS has now continued its tradition of working only with the best in selecting Attorney Andrew Friedman. He and his team of attorneys are evaluating potential claims against BCBS and ASHN.  We expect that a decision will be reached very soon concerning the most effective course of action to protect the interests of doctors and their patients through judicial recourse.

HEALINGCORNER
THE HEALING CORNER: A DIET PROVEN TO EFFECTIVELY TREAT ASTHMA

 

ACS has been disclosing medical treatments from long ago that were generally accepted by the medical profession before the drug companies became all-powerful. These treatments are as scientifically sound today as they were when first published. They are just no longer in favor because it is easier to take a pill. Consider the following dietary treatment for asthma which will work for your patients today. The source is Rochester DeLancey, MD: "The Treatment of Asthma," JAMA, Volume XLVII, Number 24, p. 1983-6, 12/15/06. Any ACS member who wants a copy of the study should send an email request. Dr. DeLancey was an Associate Professor of the Principles and Practice of Medicine at the University of Buffalo Medical College. Key quotes:

 

"The cases related are selected from a large number observed during a period of twenty-three years." "With asthma cases, an imperfect metabolism is the cause. ". . . the causes of this imperfect metabolism are to be found in the mode of life of individual; that among the most common causes are overloading of the gastrointestinal tract with other factors are a sedentary life and insufficient use of the lungs in a properly oxygenated atmosphere. In brief, my conviction, based on clinical observation, is the underlying cause of asthma is "autointoxication" due to deficient oxygenation and imperfect elimination; and I believe the results of treatment justify my position. Most cases of asthma begin early in life and by the time they come under the observation of the physician there is already more or less emphysema pulmonum present."

 

"Two of the chief evidences of the autointoxication are the degree of acidity of the urine and the degree of indicanuria present. I have never yet had a case of asthma come under observation in which there was not when first seen a strongly acid urine which deposited on centrifugalization urates and uric acid or calcium oxalate, and showed a pronounced reaction for indoxyl sulphate."

 

"From what has been said in regard to pathogenesis, the plan of treatment is simple. In the first place, all obstructions in the upper air passages should.be surgically removed, and, following the surgical procedure, there should be daily or twice daily cleansing of the nose and pharynx with a mildly alkaline cleansing douche. Powerful sprays are to be avoided. If the mucous membranes are especially sensitive, an oil application in the form of vapor is to be applied after the cleansing. The patient should be encouraged to use pulmonary gymnastics, especially forced expirations. The skin should be made active by baths and friction. The character of the baths has to be carefully considered in each case, and even when one form of bath has been prescribed, it sometimes has to be changed later. As a rule, a cold sponge bath, followed by a brisk rub, is useful in cases in which there is not present too great emphysema of the lungs; even when this is considerable, it is sometimes worthwhile to try the cold baths. A warm bath, followed by friction, may be given once or twice a week; and in all cases a hot-air sweat occasionally-once or twice a fortnight-is useful."

 

"The bowels should be kept active. At the beginning, and from time to time later, a full dose of calomel, followed by Epsom salts, should be administered. A bowel wash of saturated solution of warm boric-acid solution once or twice a week is to be recommended. The regular administration of laxatives is seldom necessary, but, when it is, a mild saline is the preferable form. The regulation of the diet is of importance only in so far as that the amount of food should be limited to the minimum compatible with maintenance of health and weight. Any article of food known to disagree should, of course, be prohibited. I generally exclude from the diet of these patients fried foods, pastry, excess of sweets, rich pudding, highly seasoned and made-up dishes, tea, coffee and all alcoholic, and effervescent drinks."

 

". . . by so regulating the intake of food and stimulating the elimination of waste products, that a proper metabolic balance may be maintained."

His own experience with back and neck pain

How did you injure your neck and back?

At age 30, I began my career as a chiropractor. Within 12 months, I had my own chiropractor due to the torque and twisting required in this profession. The more force I put into a patients spine, the more reciprocal force went into my spine. I had repeated micro-trauma on my own back. The neck pain was a result of a car wreck. I had a ruptured disc and loss of my reflexes over time.

 

What did you do for conservative treatment?

As I mentioned, I got chiropractic care and got relief, but it flared up again. The MRI showed bilateral L5 spondylolysis and grade 2 spondylolythesis. There was no L5 disc space left; it was just sitting on the nerve root. I was in excruciating pain; it was hard to stand and even sit.

 

When did you decide to pursue surgical options?

I could barely walk. My pain level was 8/9 out of 10. A series of three epidural injections provided little or no relief. I was on my back in bed working on my laptop.

 

What has back and neck surgical done to relieve your pain?

After being in the car wreck, I waited 11 years to have surgery. I had a herniated disc and had no choice at that point. That surgery was a much easier recovery than my back surgery. If I knew how I would feel after surgery, I would have done it 5 to 10 years earlier.

 

Are you able to return to an active lifestyle?

One year after my back surgery, I hiked Fish Creek Canyon in the Superstitions, going up and down steep canyon walls. I am careful about lifting weights above 40 lbs, but don't have any doctor restrictions, just my choice to play it safe. I do enjoy walking, hiking, and climbing again.

 

How has your experience changed the way you look at things as a chiropractor?

I feel even more strongly that chiropractors and orthopedic surgeons should gel. In the 1980s, I was invited to debate Dr. Anthony Yeung and in the end, we mostly agreed with one another, much to the surprise of the radio host.

 

What recommendations do you have for other chiropractors with their own patients?

There is definitely a time and a place for neck and back surgery. I would say do not hesitate to get a spine consult by a good quality spine surgeon when disabling pain is interfering with a patient's quality of life and chiropractic care is no longer giving relief. For some people, it can really be a godsend. You owe it to yourself to develop a relationship with a good orthopedic spine surgeon.
