It has been a rocky road in the State Senate for chiropractic legislation and our bills are temporarily on hold which is not unusual or worrisome. The first step was a hearing and vote in the Senate Health and Human Services Committee where our copayment bill failed by a vote of 3-4. Then, the committee chair, Senator Nancy Barto, agreed to accept an amendment from one of the no votes, Sen. Ed Ableser, and he agreed to vote yes at the next meeting, thus assuring passage. However, when the date of the meeting came, Sen. Ableser was not present and so the bill was not voted on. Therefore, the copayment bill did not pass the Senate on this initial, very early attempt.


Now we are looking for a "vehicle" bill to carry our copay bill. This is a bill on another subject which we would use for our bill. We would strip the bill of its original language and insert our copay bill language. We have a number of bills under consideration but cannot reveal which ones we plan to use so as not to alert the opposition. There are some excellent candidates and so our hopes are still very high for ultimate passage of our bill.


With the overall insurance equality bill, the powers that be are leaning towards adding language to the Unfair Claim Settlement Practices law that would require the Arizona Department of Insurance (ADOI) to take enforcement action when there are violations. ACS filed a lawsuit against ADOI for failing to enforce the chiropractic insurance equality law but the courts ruled that ADOI has no duty to enforce the law even if there are violations. Passage of this new law would make it so that if we sue ADOI again, the lawsuit would be decided on the basis of whether or not there are violations of the law, not whether ADOI has the duty to enforce the law. This would solve our problem. Expect a bill with these provisions to arise in the next few weeks as well. Even the Chamber of Commerce is opposed to ADOI not enforcing the law when there are clear violations.


The interstate purchase of insurance bill which would have undermined our insurance equality law never received a hearing in the State Senate and this is a major victory for ACS and the profession. This bill would have negated our insurance equality law if even a single out of state insurance policy was sold in Arizona that did not require coverage for chiropractic. Apparently, the proponents realized the opposition was too strong to move forward with this legislation.


The AAC AHCCCS bill failed to pass the Senate and is dead. It passed the Senate Health and Human Services Committee but then died in the Senate Appropriations Committee where it was only discussed and not voted on. This bill would only have allowed you to see AHCCCS patients if they were referred by a PCP, a highly unlikely event. ACS will only support an AHCCCS bill that allows direct access to patients without a referral by a PCP.


ACS is working extremely hard every day at the Legislature to protect your interests. If you are not a member, you should join immediately to safeguard your practice. The Legislature has the power to make or break an entire industry and those businesses which are not protected at the Legislature are in jeopardy. ACS has been announcing that Andrew Friedman of the Phoenix class action law firm, Bonnett, Fairbourn, Friedman & Balint, PC, is working on a potential class action claim against BCBS and ASHN by doctors and patients affected by the insurance companies' abusive practices relating to chiropractic care. Now the decision has been made to add refund demands to the lawsuit. If you have been hit with a refund demand by BCBS and paid money back in the past six years, contact ACS immediately to be included in the lawsuit.


On 02/25/14, attorney Brian Hufford who filed the lawsuit for the ACA against ASHN and CIGNA nationally was in Phoenix and met with Dr. Immerman and Mr. Friedman to discuss the Arizona lawsuit and other potential lawsuits. Mr. Hufford is charged with energy to take on the enemies of chiropractic in the courtroom and has been doing so across the country. He has worked with Andrew Friedman in the past and Dr. Immerman has brought the two together in Arizona to create an amazingly powerful team. Stand by for legal fireworks galore.


So the work on the Arizona lawsuit continues to progress. We cannot reveal more details other than to state the project is alive and well. Your hopes should remain high with the expectation that we will soon have good news to report. Stay tuned to the ACS publications for complete information. Once filed, this class action lawsuit will be one of the most powerful efforts ever undertaken by ACS.

Last month we reported that based on Section 2706 of the federal Affordable Care Act, aka Obamacare, insurers may only pay DCs differently from MDs based on "qualify and performance measures." Right now, ASHN will pay only $18 even if four separate physical medicine procedures are performed while paying MDs 3-4 times more for the same services. Also, insurers are paying MDs far more than DCs for performing the same exams even though there is no difference in quality or performance measures. This is illegal based on Section 2706. We have brought this issue to the attention of our attorneys and have filed a complaint with the Arizona Department of Insurance (ADOI). We believe such differences in payment are a clear violation of Section 2706, the provider non-discrimination clause of Obamacare, and will pursue justice in this area vigorously.


ADOI has responded stating it needs more evidence. This means we need EOBs from MDs, DOs and PTs showing the amount they were paid for the same CPT codes billed by chiropractors. We need you to supply ACS with such EOBs together with EOBs from your office showing what you have been paid. Once we receive this information, we will supply it to ADOI to prove our case. Then, ADOI should take enforcement action. Please supply this information as soon as possible.



Should you bill health insurance with a PI case? In most, but not all cases, the answer surprisingly is yes. ACS has developed a new position paper available under Member Benefits at as number 31.2 that we recommend you read immediately since we get questions on this issue all of the time. Are your patients experiencing chronic back or neck pain and considering a steroid shot for pain relief?  Here are the important facts that you need to know about these controversial injections.


Fact 1:  Steroid spinal injections are NOT approved by the Food and Drug Administration.  Epidural steroid injections (ESI) are given by various pain management doctors; radiologists, physiatrists and anesthesiologists with great frequency.  M.D.'s are frequently referring their patients to pain management for these spinal injections.  But, here's what most patients are never told.  ESI's are not FDA approved.  The Dr. Oz show recently did an in-depth investigation of these spinal injection procedures given at pain clinics.  Posing as patients, the investigative journalists were told, at 19 out of 20 pain clinics, that the injections were FDA approved.  That's simply a misstatement of the facts.  The steroids that are used in pain management are FDA approved for your muscles and joints, but the FDA has never approved the injections for spinal use.  Doctors are allowed to use the steroid injections into the spine as an "off-label use", but that means that the use of steroids has never undergone an official study to ensure safety and effectiveness.


Fact 2:  There are serious risks associated with spinal steroid injections.  In October 2013 a prestigious medical journal, Surgical Neurology International, reported the following facts after doing a comprehensive review of the literature related to the risks of ESI's.  "Multiple recent reports cite contaminated epidural steroid injections. Patients develop complications that often go unreported or underreported.  Life-threatening conditions from ESI's include spinal fluid leaks (0.4-6%), positional headaches (28%), spinal cord infection (6-16%), hydrocephalus, embolism, allergic reactions, stroke, blindness, paralysis, hematomas, seizures and death." 


Fact 3: ESI's are typically short-acting and ineffective over the long term. The Surgical Neurology International journal also reports that the benefits from ESI's are typically short term and states the following:  "Although not approved by the FDA, injections are being performed with an increased frequency (160%), and are typically short-acting and ineffective over the longer-term, while exposing patients to major risks and complications."   Dr. Nancy E. Epstein, a neurosurgeon, makes the following conclusion related to the effectiveness of ESI's:  "Although the benefits for ESI's may include transient relief, the multitude of risks attributed to these injections outweighs the benefits."


Several studies over the decades have concluded that ESI's work no better than injecting saline, a placebo. Another recent study published in the June 2013 Journal of Bone and Joint Surgery reports that steroid injections to ease lower back and leg pain may result with increased odds of spinal fractures because steroids can reduce bone density.
