CHIROPRACTIC BOARD REFORM: ACS MISSION ACCOMPLISHED

 

ACS' greatest accomplishment over the past ten years has been complete reform of the Arizona Chiropractic Board. A typical scenario 5-10 years ago with the Board was the following. Doctors would get a fee complaint with the Board and would have their complete patient file subpoenaed. The Board Deputy Director Charles Brown would nitpick through the entire file including patient documentation and would always find a violation such as failure to sign notes on one date of service, billing for a 99203 when the proper code should have been 99202, improper clinical decision making, failure to put "D.C." behind the doctor's name, artifacts on x-rays, etc. It was extremely rare for Mr. Brown not to find a violation. A new complaint was then opened against the doctors who were then found guilty of unprofessional conduct with a character likely to deceive or defraud the public. This finding was then reported to the National Practitioners Data Bank which in turn reported it to all PPOs and HMOs leading to termination of all provider contracts.

 

The atmosphere at Board meetings was horrendous. Doctors were treated in a rude and intimidating manner with complete disrespect. There was no professionalism at all when the Board convened.

 

ACS decided to take action in 2006. We first began to expose the Board's actions with regular reports in the ACS newsletter. All of the newsletters are still posted on the ACS website in case you want to read them. We were harshly critical of the Board. The pressure from the newsletters began to bring about change.

 

Then we began to pass new laws. One gave the Board permission to assign doctors non-disciplinary coursework in documentation and other subjects rather than disciplining their licenses. Almost immediately, scores of doctors avoided discipline to their licenses because of this new law. A second new law prohibited Board members from doing IMEs. One Board member was very active with his IME practice while judging complaints submitted by State Farm and the Legislature agreed this was a conflict of interest. We believe this is the reason the Board member in question did not seek a second five year term on the Board.

In 2006, ACS filed a massive complaint with the Arizona Ombudsman's Office against the Board. In 2008, the Ombudsman's Office issued a response. Four of the six ACS allegations were not investigated. The remaining two were found to be unsubstantiated. ACS then issued a statement strongly objecting to this conclusion and report.

 

It is very rare for any doctor to challenge the Board's disciplinary action in court due to the enormous expense involved. One doctor, Paul Pratt, D.C., did take the Board to Court. ACS filed a motion with the Court in support of the doctor. The Judge overturned almost all of the Board's discipline and stated that the Board's actions were "excessive, arbitrary and capricious." This is exactly what ACS had been saying for years and now it had come from a neutral Pima County Superior Court Judge.

 

Our goal was to rid the Board of the abusive "Gang of Four": Executive Director Patrice Pritzl, Deputy Director Charles Brown, Board Chair Dianne Haydon, D.C. and Board Vice-Chair Steven Baker. We accomplished our mission.

 

Finally, Governor Jan Brewer was elected and began to appoint more reasonable Board members. With the appointment of Dr. Jim Badge, the Board's reign of terror finally ended. We now have a reasonable and fair Board.

STATUS OF PENDING LAWSUITS

 

The lawsuit against BCBS and ASHN is pending an opinion from Attorney Brian Hufford who filed the lawsuit against CIGNA and ASHN on behalf of the ACA. Mr. Hufford has also filed a number of other lawsuits on behalf of chiropractors and state associations and so has tremendous experience. We have decided to consult with him to make sure we are doing things in exactly the right way. He is extremely busy and so this has caused some delay.


The Sec. 2706 lawsuit against United HealthCare is pending because we have not yet found sufficient plaintiffs willing to participate. If you have UHC patients who would be willing to be plaintiffs, have them contact ACS immediately. There may be financial compensation for participation. This lawsuit will allege that UHC pays chiropractors less than they pay other providers for delivering the same services. We have documentation showing that UHC pays nurse practitioners more than they pay DCs for the same services. Now all that we need are plaintiffs.

CHIROPRACTIC BOARD LISTS APPROVED COURSES ONLINE
Two Hours of Courses in Record Keeping Required for 2014 

 

The Chiropractic Board has a list online of all approved continuing education courses available at http://www.azchiroboard.us/Approvedcourselist.pdf. There is a wide range of in-person and online courses available. Bear in mind that for 2014, you must take at least two hours of courses in record keeping. There are two courses available online for two hours in record keeping to meet the requirement. They are user-friendly and easy to take. Be sure to take your CE courses from the Board-approved list in order to stay in compliance.

Nutritional Pharmacology versus Natural Hygiene 1981: This is a journal article by Dr. Immerman that contrasts the use of food as a drug versus a nutrient. It is vitally important to avoid being a nutritional pharmacologist and solely use food to nourish and not to drug the body.

 

The Cause of Colds, Sore Throats and Other Infectious Diseases: This is a cause you have never considered before, but which truly has merit to it. Consider this theory seriously.

Immerman, Alan M. D.C. The Immerman Files. Dr. Alan Immerman collected every available scrap of published scientific evidence issued between 1880 and 1980 that supported fasting and Natural Hygiene/Nature Cure. He was the Director of Research for the American Natural Hygiene Society in the 1980s. This material (a seven foot tall stack of photocopies) was then scanned by Dr. Immerman. All these articles are available for free download, organized by topic. This link leads to a short essay by Dr. Immerman explaining how the files came to be and how to make the best use of them, and from there, to the files themselves.

A very easy to understand summary and restatement of the basic hygienic viewpoint that would serve as an excellent introduction and guide to someone with insufficient time to study the fundamental books of the Founders (Tilden, Shelton, etc.) from which this book is drawn. It is vegetarian in outlook and disapproves of colon cleansing. Used by a chiropractic college in the United States as a basic text of diet and nutrition. Shelton, Herbert M. The Hygienic System, Vol. III, Fasting and Sun Bathing. San Antonio, Texas: Dr. Shelton's Health School, Third Revised Edition, 1950. First Published 1934. 

In his exhaustive study of therapeutic fasting, Shelton claimed: "In more than thirty years of conducting fasts, I have conducted over twenty-five thousand fasts, ranging in duration from three days to more than two months. I have conducted about six fasts that have gone sixty or more days, the longest being sixty-eight days. I have had literally hundreds of fasts that have lasted from forty to fifty and more days." Despite Shelton's possible overstatement of "twenty-five thousand," likely no one else has ever equaled his experience with fasting for the purpose of healing disease. PUBLIC DOMAIN.

 

Shelton, Herbert M. Natural Hygiene: Man's Pristine Way Of Life. San Antonio, Texas: Dr. Shelton's Health School, 1968.

This rather long polemic painstakingly, passionately and rather aggressively examines certain key concepts of Shelton's version of Natural Hygiene: no one who reads this book carefully will ever think of the words cure and medicine as being compatible with Hygiene or healing or health. There is also an excellent history of the development of the Hygienic movement. PUBLIC DOMAIN.

 

DeVries, Arnold. Therapeutic Fasting. Los Angeles: Chandler, 1963.

A complete, sensitive and intelligent survey of fasting and of fasting literature. Arnold DeVries was an American researcher, writer and hygienist, who already in the 1950's changed from a fruitarian (Fountain of Youth, 1946) to a paleolithic understanding of what constitutes optimum human nutrition (Primitive Man and His Food, 1952, Elixir of Life, 1952). Therapeutic Fasting, 1963) has been one of his most popular and widely used titles. Hazzard, Linda. B., D. O. (1927 edition). Scientific Fasting: The Ancient and Modern Key to Health. New York: Grant Publications. This is taken from one of a series of editions going back many years before 1927.

One of the wisest books on natural medicine ever written, and written totally from decades of personal practice. Also contains a great deal of advice about handling children. PUBLIC DOMAIN
