ACS LOBBYIST CONTINUES FIERCE PACE AT LEGISLATURE 

 

The ACS lobbyist, Debra Brimhall Pearson, is continuing a fierce pace at the Legislature which will convene the second Monday in January. She is pressing hard to pass two bills. The first would lower copays for chiropractic care from specialist to PCP levels. The second would move our insurance equality law outside of the jurisdiction of the Arizona Department of Insurance (ADOI) so that anyone could take enforcement action when there is a violation. This bill would also modify the insurance equality law so that chiropractors could no longer be singled out for utilization review.

 

ASHN now performs utilization review on every chiropractic claim while at the same time treatment of spinal conditions by MDs and PTs escapes such scrutiny. If our bill passes, the same level of scrutiny would have to be applied to MDs, DOs and DCs. There is no way insurers are going to apply ASHN level scrutiny to MD and DO claims and so there would be a rollback of ASHN reviews. 

 

The bill would also require that fee schedules be applied equally to MDs, DOs and DCs for the same services. Right now, DCs are paid far less than MDs and DOs for the same services. This would end with passage of our bill.

 

Insurers today are not paying for all medically necessary chiropractic care. ASHN aims at an average of 6.5 visits per patient while most national guidelines state the average should be over 20. Our law currently bans this practice, but ADOI refuses to enforce it. Moving our law away from ADOI would allow enforce of this key provision.

 

As we stated last month, we must wage all-out war against ASHN. Ever since ASHN came to Arizona in January, 2011, Arizona chiropractic practices have been decimated. ASHN has literally eliminated insurance coverage for chiropractic. With BCBS and CIGNA, the maximum payable is $44 and the copay is $40 so ASHN pays only $4. The paperwork required to get paid the $4 is so onerous that most doctors don't bother to complete it and accept the copay as payment in full. This cannot be allowed to stand.

 

To succeed this year, you must get involved. You must personally meet with your senator and two representatives to explain how bad things are and how hopeless it is to depend on ADOI for solutions. Start now by researching to determine who you are represented by. If you will do this then our chances of success will dramatically increase. By mid-January, you will be able to find your legislators by going to www.azleg.gov and clicking on the button "How do I find my legislator."

 

We have a full set of documentation to share with legislators. Go to the home page of ACS at www.AZChiropractors.org and look under Breaking News. Scroll down to 11/19/13. Click on packages one and two. Print out the materials and become familiar with them. Then give a copy to your legislators at the time of your meeting.

 

A key difference this year is our lobbyist. Debra Brimhall Pearson is working harder than any lobbyist we have had for the past five years. This will also make a huge difference. Ms. Pearson is also highly effective since she served as a state representative from 1997 to 2003 and a number of the people she served with are still in office today along with the staff she worked with at that time.

 

Do you want $44 visits with $40 copays for the rest of your career? Then do something about it. Meet with your legislators and express your disgust. Explain that it is not really insurance at all when the insurer only pays $4 out of a $44 visit. It is insurance fraud and consumer fraud. Bring along EOBs show the $4 payment per visit. We have found that legislators are shocked to see this in print. Get to work and support our lobbying effort and together we will achieve victory.

HOW YOU CAN QUALIFY AS AN EXPERT WITNESS IN CLINICAL BIOMECHANICS

 

Chiropractors often treat automobile accident victims. These cases sometimes go to trial and the doctor is called to testify regarding the injuries and treatment. Ordinarily, the doctor will limit testimony to the medical necessity of the care that was rendered, and the reasonableness of the fees charged. Most chiropractors will not venture into the world of biomechanics, falsely believing that a chiropractor is not an expert in this area. Nothing could be further from the truth.


 

First, let's define an expert witness. An expert witness "is a witness who has knowledge beyond that of the ordinary lay person enabling him/her to give testimony regarding an issue that requires expertise to understand. Experts are allowed to give opinion testimony which a non- expert witness may be prohibited from testifying to. In court, the party offering the expert must lay a foundation for the expert's testimony. Laying the foundation involves testifying about the expert's credentials and experience that qualifies him/her as an expert." (http://definitions.uslegal.com/e/expert-witness/)


 

Experts are also defined as any individual "who possesses specialized knowledge through skill, education, training, or experience beyond that of the ordinary person or juror, and whose knowledge will aid the trier of fact (jury, judge, arbitrator) in reaching a proper decision."

 

So is a chiropractor an expert in biomechanics? Where do we look to begin to establish this fact? First, look to the doctor's education. Every chiropractor has completed courses in Chiropractic College in the biomechanics of the cervical, thoracic and lumbar spine, along with the extremity joints. The Council on Chiropractic Education (CCE) which mandates curricula for the chiropractic colleges requires education in biomechanics. Therefore, chiropractors are fully educated in biomechanics.

 

This satisfies the test of having knowledge "beyond that of an ordinary lay person enabling him/her to give testimony regarding an issue that requires expertise to understand." Therefore, all chiropractors are experts in biomechanics.


 

When you think about it, it is really quite obvious. When a chiropractor examines the spine, the exam looks for biomechanical abnormalities involving individual vertebrae. The vertebrae may be out of position, not moving normally, fixated, etc. The chiropractor's job is to apply treatment, primarily adjustments, to correct these biomechanical abnormalities. You could even call a chiropractor a "clinical biomechanist."


 

Who better to understand the biomechanics of whiplash injuries? As each mechanism of injury has been discovered, chiropractors are in a unique position to understand how these injurious movements in the spine could cause significant problems. Chiropractors also are in a unique position to know clinically how to design biomechanical treatments (adjustments) to correct these problems.


 

Insurance companies today frequently retain biomechanical experts to testify that there was not enough force to cause injury. Part of their analysis involves calculating the amount for force involved in the accident. However, most of their analysis is a biomechanical analysis that any expert in biomechanics such as you can critique. Now that you know you as a chiropractor are an expert in biomechanics, it is time for your to start reviewing and critiquing the biomechanical analyses of the insurance experts. You will find them woefully deficient in many cases and can be of great help to your patient's case with your expertise.


 

As part of a packet available on request to ACS members, we have included samples of the curriculum from the National University of Health Sciences and the requirements from CCE that mention biomechanics courses. Never again let anyone tell you that you are not an expert in biomechanics. The fact is that every chiropractor is an expert in clinical biomechanics and you should stand up and say so.
