prescription drug abuse |
Prescription Drug Abuse in America (Part One): The Problem, by Stuart Colburn, Esq. We are killing our children. We are killing their parents, too. When we are not successful killing them, we destroy their lives and the lives of their families. And for the most part, it is legal. Hyperbole aside, no one intends such damages on our citizens. America's prescription drug abuse (PDA) problem is not nearly as well known as our War on Drugs. No war has been declared and yet American lives are being lost. The statistics are well known. American citizens make up 4% of the world's population. Yet, we consume 80% of the opiates, 71% of the oxycodone, 99% of the hydrocodone, and 66% of the illegal drugs in the world. > Learn more.

U.S. Supreme Court to Review Longshore Average Weekly Wage Issue, by John E. Kawczynski, Esq. The Supreme Court has granted certiorari in the case of Dana Roberts v. Director, OWCP (Sea-Land Services, Inc.), 625 F.3d 1204, 44 BRBS 73(CRT) (9th Cir. 2010). This case will resolve a split in the circuits regarding the interpretation of Section 6(c), 33 U.S.C.S. § 906(c). This section determines which fiscal year's maximum and minimum compensation rates apply and is a companion to Section 6(b)(1)-(3), which sets forth the method of calculating the maximum and minimum compensation rates. See 33 U.S.C.S. § 906(b)(1)-(3). > Read more. |

Another Busy Year for Workers' Compensation and Occupational Health, by Brian J. Caveney, MD, JD, MPH
This was another busy year for workers' compensation and occupational health. In light of the passage of the Patient Protection and Affordable Care Act (PPACA) of 2010, many were trying to predict its impact on access to care, coordination of benefits, and relative usage of workers' compensation. Much remains to be seen, as its provisions are implemented, what the intended and unintended consequences will be, as access to health insurance coverage is potentially expanded under the new law.> Read more. |

the overtreated society |
Workers' Compensation in a Medically Overtreated Society, by Robin E. Kobayashi, JD. Workers' compensation is no stranger to controversy. In 2009 the well-respected physician Nortin M. Hadler, MD, attacked workers' compensation as an "evil, wrong-minded, illness-inducing maze that masquerades as social insurance". You can read all about it in his book Stabbed in the Back: Confronting Back Pain in an Overtreated Society (see Judge Torrey's book review). In his latest book, Rethinking Aging: Growing Old and Living Well in an Overtreated Society, published Sept. 2011, Dr. Hadler continues his no-holds-barred approach... > Read more.
