"The End of Unions?" That's the headline grabber at The Globe and Mail, a Canadian news agency, which reminds us about the national (and Canadian) consequences of the labor showdown in Wisconsin between GOP Governor Scott Walker and the public sector unions. Governor Walker seeks to sharply curtail collective bargaining rights of certain public sector unions in his state. Critics have queried whether his plan is truly to repair the state's budget or rather a power grab to bust unions.

 

The Upside of Anger: Last Saturday 70,000 protestors rallied in support of public sector unions in Wisconsin. Protestors are sleeping inside the statehouse, and they plan to form a human chain around the building if they're evicted. Meanwhile Tea Party members are also protesting but in support of Governor Walker's plan.

 

Regardless of which side you're on when it comes to this union battle, we all know that unions have historically played a key role in the development and ongoing reforms of workers' compensation systems across the country.

 

Why should we care? Wisconsin is known as a bellwether state. It was the first state in the country to implement unemployment benefits, workers' compensation, and direct primary elections. It also developed the progressive income tax. We'll be watching then to see what happens in Wisconsin and also Ohio, where proposed legislation to curtail collective bargaining rights for public employees is already gathering steam.

 

Five years ago Indiana eliminated collective bargaining rights for its state employees. According to The New York Times, the impact of Governor Mitch Daniel's executive order has resulted in no pay raises, a weakening of seniority preferences and the loss of jobs due to outsourcing and consolidation.

 

Interestingly, Governor Walker has threatened to lay off 12,000 public employees if his plan to curtail collective bargaining isn't adopted. But wouldn't public employee lay offs be an end goal in his plan anyways?

Police Officer's Injuries During Fight Outside a Tavern Held Not Compensable. In Graves v. Workers' Comp. Appeal Bd. (Phila. Hous. Auth.), 983 A.2d 241 (Pa. Commw. Ct. 2009), the court found substantial evidence supported findings that a police officer did not sustain a compensable injury while in the course and scope of his employment. The officer's own testimony was that he was off-duty, had gone to the tavern where a private party was taking place, and he was shot following an altercation that took place both inside and outside the bar. [See Ch. 8, § 8.01[1][a] n2 (Digest)]
