Labor Code Section 139.48 - The Return To Work Fund: What We Know and What We Don't Know, by Robert G. Rassp, Esq. Disclaimer: This article was written before regulations have been proposed to implement the Return To Work Fund. You are encouraged to pay close attention to all rules and regulations promulgated by the DIR and WCAB to implement the $120,000,000 Return To Work Fund. As part of the comprehensive workers' compensation reform in SB 863 that was signed into law by Governor Edmund G. Brown on September 18, 2012, the legislature passed a provision in the Labor Code, section 139.48, that provides an annual fund of $120,000,000.00 from which eligible injured workers may receive money that compensates them in cases where there is a disproportional difference between their permanent disability ratings and their loss of future earning capacity. How is this fund going to be established, who pays for it, who administers it, how will it be implemented, and what role, if any, will attorneys have in representing or defending claims for these benefits? Medical Provider Networks; Treatment Outside Medical Provider Network. WCAB, rescinding WCJ's finding, held that defendant was liable for medical treatment self-procured by applicant who suffered 2/3/2012 admitted industrial left shoulder injury, when WCAB found that defendant's failure to provide applicant with required notice of his MPN rights at time of hire and of injury pursuant to Rules 9767.5 and 9767.9, and failure to assure continuity of medical treatment was a neglect or refusal to provide reasonable medical treatment pursuant to Knight v. United Parcel Service (Appeals Board en banc opinion) that rendered defendant liable for self-procured medical treatment, and that subsequent letter and attachment sent by defendant to applicant's attorney was not sufficient to cure defect in notice because letter was not correct or complete in advising applicant regarding how to select an MPN physician.
