It is hard to imagine a Workers' Compensation Administrative Law Judge (WCJ) ordering a defendant to pay a marijuana co-operative or other supplier directly for the provision of marijuana. The defendant would argue that the purchase of marijuana is illegal and that it cannot be compelled to perform an illegal act. But is the issue really that simple? ex parte communication |
This noteworthy panel decision will be added to the LexisNexis Services.
Medical-Legal Procedure; Ex Parte Communications With PQME. WCAB, denying defendant's petition for removal and request for a replacement QME panel, held that applicant did not engage in prohibited ex parte communication with panel QME in violation of Labor Code § 4062.3(f), when WCAB found that emails sent by panel QME to applicant were in regard to Employee Disability Questionnaire needed to complete QME examination and were not prohibited because they were "in connection with examination" pursuant to Labor Code § 4062.3(h), that sending of claims adjuster's phone number was insignificant and inconsequential, and that there was no record that applicant replied to any of the emails. See Nelson panel decision. |
