New Jersey Clarifies Effective Date for "Gender Equity Pay" Posting and Distribution Requirement for Employers


Effective November 19, 2012, New Jersey is requiring all employers with 50 or more employees to post a notice in each of their locations detailing the employee's right "to be free of gender inequity or bias in pay, compensation, benefits or other terms or conditions of employment" under every applicable statute which provides for gender pay equity. Recently, the New Jersey Department of Labor and Workforce Development (NJ LWD) posted an updated notification on its website indicating that, although the new law became effective on November 19, 2012, the employer's obligation under the law is not "triggered" until the Commissioner of Labor issues for publication the "final notice of adoption" in the New Jersey Register.

 

The notice from the NJ LWD explains that the process necessary for attaining such a final notice of adoption takes months and involves several stages to include a notice of the proposed regulations, a public comment period and ultimately, the publication in the New Jersey Register.
