NEW Equal Pay Posting Requirement for
 NJ Employers


Effective November 19, 2012, New Jersey will require all employers with 50 or more employees to post a notice in each of their locations detailing the employee's right "to be free of gender inequity or bias in pay, compensation, benefits or other terms or conditions of employment" under every applicable statute which provides for gender pay equity. (NJLAD, Title VII, Equal Pay Act).

 

The Notice must be provided to: 

  • All current employees
  • New employees upon hire
  • Annually, on or before December 31, 2012
  • An employee upon first request

 

The employer must make the Notice "available" through one of the following means: 

  • Email
  • Printed copy (i.e. paycheck insert, new hire brochure/info packet, employee manual/handbook, disseminated flyer)
  • Internet/Intranet site if the site is accessible by and for the exclusive use of all workers. If using this means of notification, the employer must provide notice of the posting.

 

Other Requirements: 

  • The notification must contain an acknowledgment of receipt, and that it was read and understood by the employee. This acknowledgment must be signed and returned within 30 days of receipt.
  • The employer must post the Notice in English, Spanish and any other language the employer believes is the primary language spoken by a significant portion of its workforce.
