Universal Wastes: Deciphering the Differences Between Federal and State Requirements

The familiar universal waste program began in May 1995, when EPA promulgated streamlined management standards for hazardous waste batteries, pesticides, and thermostats. Although authorized states are not required to adopt the federal universal waste rule, all states have established some form of universal waste program, either by adopting all or part of the federal rules or by creating their own state-specific regulations. State rules may differ from the federal standards in many aspects.  >>>

EPA Issues Revised Boiler MACT Standards

On December 20, 2012, the Environmental Protection Agency (EPA) finalized a set of adjustments to the National Emissions Standards for Hazardous Air Pollutants (NESHAP) for boilers and solid waste incinerators-commonly called the "Boiler MACT" standards. The revised rules were the outcome of an array of legal and regulatory challenges to Boiler MACT since the rules were first finalized in March 2011. >>>

     

ReminderFacilities with boilers or process heaters subject to these MACT standards must submit an initial notification. If the startup date of the unit was before January 31, 2013, the initial notification must be submitted no later than May 31, 2013.

 

If the startup date is after January 31, 2013, the initial notification must be submitted no later than 15 days after startup.

Many facilities use a paint booth or a ventilated spray area to limit employee exposure and prevent accumulation of explosive atmospheres. Most equipment used in such booths requires electricity. Vapors from flammable liquids don't play well with electricity (think fires and explosions). >>>

Many EHS professionals working in industry understand their obligations for adherence to applicable environmental and occupational safety and health regulations, but may rely on their Facilities or Maintenance departments or their property underwriter to ensure compliance with Fire Codes. That may not be a sound risk management strategy. Beyond addressing the design and construction of the physical plant or fire protection and extinguishing systems, Fire Codes impinge on a wide range of safety issues such as:
  • storage, handling, and use of hazardous materials such as corrosives, oxidizers, toxics, flammable/combustible liquids, flammable solids, and combustible dust;
  • production and maintenance activities such as spraying/dipping/coating using flammable and combustible liquids, welding/hot work, and refueling;
  • stationary battery systems; and
  • emergency evacuation and drills.

Many of these issues overlap to some degree with federal OSHA regulations, but the Fire Codes are typically more prescriptive than OSHA requirements. The two primary Fire Code standards used in the United States are the International Fire Code (IFC) and NFPA - 1 Fire Code. Almost all states have adopted one or the other, frequently with state-specific modifications. The complexity of Fire Codes is compounded by the fact that each of the primary standards (IFC and NFPA) draws upon literally hundreds of other standards that are either extracted or incorporated by reference.

 

Our presenter will be Russ Boesch, CPEA, CHMM.  Russ is a Senior Program Director in our Nashua, New Hampshire office. He is a Certified Professional Environmental Auditor and the primary author of the Fire Code Management Of Hazardous Materials Guide, published by Specialty Technical Publishers of Vancouver, Canada.

Curt Johnson will serve as a presenter at the Auditing Roundtable South Central Regional Meeting on April 19, 2013. The theme of this meeting is "EHS Auditing Tools: Overview, Applicability, and User Perspectives" and will focus on various EHS auditing tools and protocols. Curt and his co-presenter, Andy Giffen, Director of IT, Specialty Technical Publishers, along with several other tool providers will demonstrate how their products/services work, providing an overview of key features and latest improvement. The presentations will also offer feedback of the product/services, with real-life examples of their use.
