AB 22 (Tony Mendoza-D-Artesia) - Employment: Credit Reports
This bill would prohibit an employer from obtaining a consumer credit report for a prospective employee unless the report is "substantially job-related". "Job related" is defined to mean that the position of the person for whom the report is sought has access to money, other assets, or confidential information and is a managerial position. "Managerial position" is defined (in part) as "a position held by a person who has authority , in the interest of the employer, to hire, transfer, suspend, lay off, recall, promote, discharge, assign, reward, or discipline other employees...". This prohibition will make it extremely difficult to verify information that the applicant wrote on his application for the position. CIGA Position: OPPOSE.
AB 350 (Jose Solorio-D-Santa Ana) - Displaced Janitor Opportunity Act
Existing law, the Displaced Janitor Opportunity Act, required contractors and subcontractors that are awarded contracts or subcontracts by an awarding authority (i.e. business owner) to provide janitorial or building maintenance services at a particular job site, or sites, to retain, for a period of 60 days, certain employees who were employed at that site by the previous contractor or subcontractor. AB 350 would rename the Act the Displaced Property Service Employee Opportunity Act and make the provisions of the act applicable to property services, which would include licensed security , window cleaning, and food cafeteria and dietary services in addition to the janitorial and building maintenance services. It would also expand the retention period to 90 days, and the employees could only be terminated for cause, based on the performance or conduct of the employee. The main reason that a business owner would change companies for the above services is poor performance, or increasing costs. This bill would require a service-provider to hire the employees who worked on that site, even at the possibility of firing some of their current employees, and requires the business owner to recognize, and bargain with, any labor organization that was is place with the previous contractor. Nutritional Labeling for Meat
N.G.A. has pulled together a guide for retailers and wholesalers to USDA's final rule for nutritional labeling of ground or chopped meat and poultry products, which goes into effect January 1, 2012. An updated poster is being finalized by FMI and will be made available to the food industry in a couple of weeks. This guide should be a good resource for your members and may help to answer some questions while providing guidance.

California Bans Caffeinated Beer
The governor signed the bill into law on August 1st, which also covers any alcoholic beverages with caffeine.
SACRAMENTO, Calif. - While most manufacturers have reformulated their caffeinated beers to delete the caffeine, states continue to ban production and sale of alcoholic beverages containing caffeine. California became the seventh state to ban the sale and production of caffeinated beer when Gov. Jerry Brown signed the law, the Associated Press reports. Three years ago, regulators and other critics began pressuring manufacturers of such drinks as Joose and Four Loko to take the caffeine out of their beers. Opponents said the sweet, fruit-flavored beers appealed to young drinkers, especially minors. State Sen. Alex Padilla authored the original bill, saying that caffeinated alcoholic beverages threaten public health because of the way caffeine works to hide the alcohol's effect. "The added caffeine masks the effects of the high alcohol content, which can lead to binge drinking and dangerous behavior," he said.
