Welcome to our briefing update for April 2011.

 

This is the month of bunting filled street parties with a Windsor theme. But if you haven't yet received your invitation to the Royal Wedding Breakfast there are many other places in the capital to celebrate in style.

 

Book your place to watch the day's events unfolding at Galvin at Windows through plate glass windows overlooking the Queen's garden and the RAF flypast just after 1.30pm. Alternatively you can venture down to the Narrow for a "BBQ and Bunting" extravaganza.

 

In this newsletter we focus on the various issues faced by restaurateurs including VAT, minimum wages and extended opening hours for the Royal Wedding.

Sausage Seller Wins VAT Battle at ECJ.sausage and chips

 

Manfred Bog, a sausage and chips seller who sold his snacks from 3 mobile snack bars at weekly markets has last month secured a ruling from the European Court of Justice that he he is not obliged to charge the full rate of VAT.

 

In the main, the court held that his sausages required so little preparation that they did not fall under the definition of catering. It also found that the same rules should apply to popcorn and nachos sold in German cinemas.

 

The decision has caused a flurry of activity as accountants and VAT specialists believe that the decision could "open the floodgates" for VAT refund claims from operators of food stalls such as at football matches and music festivals as well as from cinemas.

The case seems to indicate that simple hot takeaway food products such as sausages will be potentially VAT-free whereas more complex food which needs more preparation will attract VAT. 

 

But will it apply to the UK? HMRC have stated that they will review the decision carefully but they do not believe the decision has application in the UK as both supplies of food and supplies made in the course of catering in the UK are treated as supplies of goods. If this is not the case, hot take away food could attract zero rate tax going forward and suppliers could reclaim over paid VAT going back 4 years. Big fast food operators are already reported to be submitting "protected claims" in order to protect their position and claims whilst legal challenges are being prepared.

Minimum Wage

The Government will raise the national minimum wage later this year. This will affect staff contracts of employment at restaurants and all other businesses.

 

The following rates will come into effect on 1st October 2011:

  • The adult rate will increase by 15p to £6.08 an hour;
  • The rate for 18-20 year olds will increase by 6p to £4.98 an hour;
  • The rate for 16-17 year olds will increase by 4p to £3.68 an hour; and
  • The rate for apprentices will increase by 10p to £2.60 an hour.

Please bear in mind however that the London Living Wage is currently set at £7.85. Although this is not a statutory right it is independently set by the GLA every year and is calculated according to the cost of living and gives the minimum pay rate required for a worker to provide their family with the essentials of life.

Royal Wedding Extended Opening Hours

On 5th April 2011 the Government brought into force an Order relaxing licensing hours to celebrate the Royal Wedding of our William and his Kate.

 

Section 172 of the Licensing Act 2003 allows the Secretary of State to make an order relaxing opening hours for licensed premises to mark occasions of 'exceptional international, national or local significance'.

 

The Order will allow licensed premises in England and Wales to stay open between 11pm on Friday 29 April and 1am on Saturday 30 April, and between 11pm on Saturday 30 April and 1am on Sunday 1 May for:

 

· the sale or supply of alcohol for consumption on the premises;

· regulated entertainment; and

· late night refreshment where alcohol is also sold or supplied for consumption on the premises.

 

The Order will apply to all licensed premises in England and Wales that have the relevant authorisations on their licence or certificate. For example, a pub with a licence to sell alcohol for consumption on the premises and put on live music will be able to extend its opening hours for both those activities under the Order.

 

The Order will not apply to businesses that do not have the relevant authorisation on their licence. For example, a village hall that does not have a licence to sell alcohol for consumption on the premises will not be permitted, under the Order, to sell alcohol during the extended opening hours.

 

The Order will not apply to premises where alcohol is consumed off the premises such as off-licences and supermarkets; or to premises which provide late night refreshment but which do not also sell alcohol, such as takeaways.

Restaurant owners (along with other businesses) have a legal responsibility to ensure that they produce, store, transport and dispose of business waste without harming the environment.

Smart businesses know and follow the rules but also look for ways to comply and save money. Westminster Compliance is a company which specialises in Environmental as well as Health and Safety Compliance.

Cooking oil and waste fat can be purchased from any restaurant and then taken to a plant in Walthamstow where it is converted into bio degradable fuel, so everybody wins. With the advent of so many new technologies Westminster can show most businesses how to save a minimum of 10% from their energy costs.
