USCIS Annouces Interim Rule on H-1B Visas
Rule Modifies Selection Process & Prohibits Multiple Filings

Greetings!

The USCIS made a final ruling last Wednesday that will prohibit employers from filing multiple H-1B petitions for the same employee. 
 
New Rule Issued by USCIS Impacts H-1B Visas
h1b visaThese changes will now ensure that companies filing multiple H-1B petitions for the same H-1B worker will be denied or have their applications revoked by the USCIS.  The USCIS will also NOT refund any filing fees submitted with duplicate petitions.

This rule will not prohibit employers from filing petitions on behalf of the same alien for different positions, based on actual business needs.  The interim rule will become effective upon publication in the Federal Register.
