OCA Board of Directors Meeting & Luncheon Canceled
The Oklahoma Cattlemens Association Board of Directors Meeting and luncheon that was scheduled to take place this Tuesday, Feb. 11 has been CANCELED.
The Cattlemen's Leadership Academy session that was scheduled for Tuesday and Wednesday (Feb. 11 & 12) has also been canceled.
We are thankful for the much needed moisture we have received, but do not want to put any of our members at risk trying to travel more than necessary.

Legislative Tracking Files
This is the second week of the second session of the 54th Legislature.

Lesser Prairie Chicken Conservation Plan Landowner/Producer Sign-up Period Open
Landowner/producers can apply to enroll their land in the Lesser-prairie Chicken Conservation Program through Feb 28, according to the Western Association of Fish and Wildlife Agencies (WAFWA).
Those with land in the lesser prairie-chicken range willing to implement conservation practices beneficial to lesser-prairie chickens are eligible. Landowner/producers who are accepted will receive a sign-up incentive and payments for implementing conservation practices designed to maximize the value of their property to lesser-prairie chicken. Those practices include mechanical brush removal, prescribed grazing, and establishment and management of planted native grass stands. Only producers not currently enrolled in federal farm bill programs will be eligible to apply for five- and 10-year contract options.
The WAFWA will rank applications based on their value to lesser prairie-chickens and select the highest ranking offers for enrollment. Accepted landowner/producers located in the high-priority locations can receive payments of up to 125 percent of the estimated cost of implementing the conservation plan. If the species becomes federally listed, participating producers will be exempt from the take prohibition of the Endangered Species Act (ESA) if the take occurs while implementing the practices prescribed in their conservation plan. Producers who are interested in the program should contact their local state wildlife agency office for more details or to complete an application.
After the sign-up period is complete, the WAFWA will also be developing similar conservation plans for producers who just want to be exempted from the take prohibitions of the ESA. The management prescriptions in these plans won't be as conservative, and landowners won't receive payment for implementing them. However, if the species is listed, any take that occurs while implementing the prescribed practices will be exempt from the take prohibitions of the ESA. Producers interested in this type of conservation plan should also contact their local state wildlife agency.
The WAFWA consists of 23 state and provincial wildlife agencies that have primary responsibility and authority for protecting and managing fish and wildlife in the western United States and Canada. The state wildlife agencies in Kansas, Oklahoma, Texas, New Mexico, and Colorado are members of the WAFWA. Through the WAFWA, those five state wildlife agencies worked cooperatively over the last two years to produce the Lesser-prairie Chicken Range-wide Conservation Plan (RWP) as a means to preclude a federal listing of the species under the ESA. On October 23, 2013, the U.S. Fish and Wildlife Service (USFWS) endorsed the RWP as "a comprehensive conservation plan that reflects sound conservation design and strategy that, when implemented, will provide a net conservation benefit to the lesser prairie-chicken." To date, the RWP is the only plan that has been endorsed by the USFWS and is the only pathway that has the potential to lead to a not warranted final decision. The amount of voluntary enrollment in the RWP will likely weigh heavily into the final listing decision that must be announced by the end of March.

Documentation of Livestock Losses
The 2014 Farm Bill is in its final stages of passage. Within the Farm Bill, there is legislation for permanent disaster assistance programs for livestock producers.
The Farm Bill, if passed in its current form, will retro-actively re-authorize the Livestock Indemnity Program (LIP), the Livestock Forage Program (LFP) and the Emergency Assistance for Livestock, Honey Bees and Farm-Raised Fish (ELAP) back to October 1, 2011.
Past livestock disaster programs have required livestock producers to maintain good records and be able to provide various documentation for the different programs. In general, producer's farm records must be updated in the FSA system to show land ownership or proof of control of the land in the form of a written lease. All acreage grazed must also be reported to FSA in order to determine payment eligibility for LFP.
LIP provides financial relief to producers that lost livestock due to eligible adverse weather events. In past programs, to qualify livestock producers were required to provide documentation proving the death of eligible livestock and that these deaths occurred as a direct result of an eligible adverse weather event. If adequate verifiable proof of death records documentation is not available, a livestock producer may be able to provide other reliable records, along with verifiable beginning and ending inventory of livestock, as proof of death. If the above documentation cannot be provided there may be limited situations in which third parties who are not affiliated with the farming operation may certify the livestock deaths.
LFP provides payments to eligible livestock producers whose pastures have been affected by drought as reflected on the U.S. Drought Monitor. In past programs, producers were required to certify their livestock numbers by category including livestock that may have been sold because of the drought. To assist the producer in certifying their livestock numbers it is helpful and sometimes required for producers to provide record of livestock purchases and sales.
ELAP provides assistance for eligible losses not covered by LIP or LFP. This may include grazing losses or produced/purchased forage or feedstuffs which were destroyed by wildfires or flooding. This program may also provide financial assistance to producers whose livestock have been stranded due to severe adverse weather such as blizzards. Producers should be prepared to provide proof of produced forages as well as receipts for purchased forages or feedstuffs.
With pending passage of the Farm Bill legislation, now would be an excellent time to begin compiling documentation supporting your livestock associated losses related to adverse weather conditions and wildfires since October 1, 2011.
At this time we are uncertain when the Farm Bill will be passed and when FSA County Offices will be able to accept applications for the livestock disaster assistance programs, so watch for additional news releases with more information.
