Q: As a seller, do I have to disclose things that are not readily observable by the Buyer?
A: Yes. The seminal case regarding a seller's duty to disclose is Johnson v. Davis. The Florida Supreme Court in Johnson held that where the seller of a home knows of facts materially affecting the value of the property which are not readily observable and are not known to the buyer, the seller is under a duty to disclose them to the buyer. This duty is equally applicable to all forms of real property, new and used. Simply stated, if the seller is aware of a defect, it must be disclosed. Examples of defects that must be disclosed are leaky roofs (Johnson), differential settling, exterior stucco delamination, erosion, sound transmission problems, termite damage, dry rot, etc. If a seller is in doubt as to their duty to disclose, they should seek the advice of a real estate lawyer.
