FCC Adopts NPRM Addressing Technology Transitions
On November 21, the FCC adopted a notice of proposed rulemaking (NPRM) and declaratory ruling designed to protect consumers, competition and public safety in the ongoing technological transitions.
The NPRM tentatively concludes that carriers seeking to discontinue a service used as a wholesale input should be required to provide competitive carriers equivalent wholesale access going forward. It also proposes to update the FCC's rules to ensure that competitive carriers receive sufficient notice of when copper networks are being shut off, so that they can continue to serve their customers effectively.
Additionally, the NPRM seeks to increase transparency to empower and protect consumers during transitions, when carriers plan to retire existing copper networks, and proposes a framework for ensuring consumers are able to call 911 during a power outage. "COMPTEL commends the Commission for its commitment to ensuring that public safety, competition and consumer protection are preserved during the technology transitions," said Chip Picerking, COMPTEL's CEO. "Competitors have been leading the way on the IP transition for more than a decade, providing businesses, schools and libraries, nonprofits, the government and public safety agencies with alternative, innovative choices in the marketplace." He added: "As incumbents embrace and adopt IP technology, it is imperative that competition continues and that access to customers via the last mile is not disrupted. Equivalent wholesale access at equivalent rates, terms and conditions is a critical component to promoting competition and ensuring that competitors can reach their customers. The rulemaking that the Commission initiated today is an important step in providing the certainty competitors require to continue investing in the marketplace and benefitting business customers throughout the nation. We look forward to working with the Commission in this proceeding to ensure that competition advances as technologies evolve."

FCC Announces December Meeting Agenda
Last week, the FCC announced its tentative agenda for the December open meeting. Subjects to be addressed include:
- Modernizing the E-rate Program for Schools and Libraries: The Commission will consider a Second Report and Order on Reconsideration to close the school and library connectivity gap by adjusting program rules and support levels in order to meet long-term program goals for high-speed connectivity to and within all eligible schools and libraries.
- Connect America Fund Report and Order: The Commission will consider a Report and Order finalizing decisions necessary to proceed to Phase II of the Connect America Fund
- Broadcast Incentive Auction Public Notice: The Commission will consider a Public Notice that asks for comment on the detailed procedures necessary to carry out the Broadcast Incentive Auction. The Public Notice includes specific proposals on auction design issues such as determination of the initial clearing target, opening bid prices, and the final television channel assignment process.
The meeting is scheduled for 10:30 a.m. on Thursday, December 11 at FCC headquarters and will be webcast online at FCC.gov/live.
Chairman Addresses Ways to Bridge Rural Divide On November 20, FCC Chairman Tom Wheeler authored a blog in which he discussed two items he is circulating that are intended to expand access to broadband across rural America.
One proposal would close the digital divide in rural schools and libraries by modernizing the FCC's E-rate program. It includes targeted updates to E-rate rules to help defray the high costs rural libraries and schools face in achieving high-speed Internet connectivity, particularly the one-time infrastructure upgrade costs that many simply can't afford. The Chairman has recommended the cap on what all Americans contribute to the E-rate fund be increased by 16 cents a month for a telephone line. The second proposal would bring the minimum broadband speed for receiving USF support to 10 Mbps for downloads, from 4 Mbps - the first adjustment since 2011.
