Session Proposals Being Accepted until November 30
COMPTEL is now accepting session proposals for the COMPTEL PLUS Spring 2013 Convention & EXPO, which is taking place March 10-13, 2013 at the Aria Resort in Las Vegas.  All session proposals must be submitted by no later than Friday, November 30, 2012.
 
We invite you to share your insights into business strategies, innovative technologies and/or regulatory trends that are shaping the future of the competitive communications industry.  Below you'll find some general themes we are considering for our agenda. AT THE FCC
AT&T Files Petition About TDM-to-IP Transition
On November 7, AT&T filed a petition with the FCC requesting the Commission to launch a proceeding on the transition from TDM to IP networks. In the petition, AT&T asks the FCC to oversee a trial in which it would move all ILEC customers off the TDM network and onto an IP network in select wire centers in order "to facilitate an industry-wide dialogue on the appropriate regulatory framework" for the transition. AT&T's petition also includes a request that VoIP and other IP services remain "free of legacy regulations" and that carriers be barred from demanding TDM-based interconnection or services as ILECs replace circuit switched telephony with VoIP. In addition, AT&T makes no commitment to interconnect with competitors on an IP-to-IP basis.

While COMPTEL is intrigued with AT&T's petition, the association disagrees with AT&T's argument that consumer protection regulations are unnecessary in an all-IP world. COMPTEL believes that the FCC must ensure that pro-competitive policies and regulations remain in place as technology upgrades are implemented so that consumers can continue to have a choice of providers."

FCC Order Clarifies Wholesalers USF Obligations
On November 5, the FCC released an order designed to clarify the USF contribution obligations of wholesale carriers. In the order, the Commission acknowledged that its procedures in the past may "have led to some instances where neither the wholesaler nor its carrier customer contributed" on certain revenues.  As part of the order, the FCC instructed the Wireline Competition Bureau to modify the 2013 Form 4099A instructions to make clear that wholesalers must ensure that their reseller customers both (1) incorporate the purchased services into their own service offerings, and (2) contribute to USF based on end user revenues from those offerings in order to avoid contributing  on those carrier to carrier revenues.

Through December 31, 2013, the FCC will consider it sufficient for providers to demonstrate a reasonable expectation that particular customers were resellers by relying on reseller certificates that are consistent with the language in the 2012 Form 499A instructions.  Then, beginning in 2014, reseller certifications will have to be made on a service by service, rather than an entity by entity basis.
