If Your Employees Drive for Your Business, be Aware of Rules about Cell Phone Use
Do your employees drive commercial motor vehicles (CMVs) as part of your business operations? If they do, it's important that you and they know about stringent regulations that went into effect nationwide in early driving with cell phone2012, restricting the use of handheld cellular phones while driving.

The U.S. Department of Transportation ruling restricts CMV drivers from the following:

 

  • Making a call while holding a cell phone
  • Dialing a cell phone using more than one button

 

It would have banned reaching for a cell phone in an unsafe manner, but after push-back from a variety of industry associations, the DOT amended the rule to permit drivers ...

"Tis the Season" for
Background Checks  
Retailers are anticipating a much improved holiday season this year compared to last year. Six retail giants in America will, together, add more than 300,000 temporary workers during the holiday season to accommodate the anticipated higher volume of holiday shoppers. The National Retail Federation predicts that this year's holiday sales will increase by 4.1 percent to  $586.1 billion. Each year, large retailers try to predict how well they will do months in advance in order to  estimate how many is this the right personadditional employees they need to hire for the holiday shopping season. Still, employers risk missing the mark. 

Many seasonal applicants hope that their seasonal jobs will turn into permanent positions. Retailers, on the other hand, expect that most seasonal jobs will end with the season. When the holiday season arrives, many managers and supervisors are faced with hiring additional employees in a short amount of time. Even so, hiring managers should avoid dangerous shortcuts when hiring seasonal workers.

Reminder: Employers Must Update FCRA-Required Forms
The Consumer Financial Protection Bureau (CFPB) has released new regulations requiring employers to update forms mandated by the Fair Credit Reporting FCRA sealAct (FCRA) by January 1, 2013. The changes consist primarily of substituting the CFPB for the Federal Trade Commission (FTC) as the point of contact for questions regarding consumers' rights under the Act. The CFPB assumed enforcement and rulemaking authority from the FTC under the Dodd-Frank Wall Street Reform and Consumer Protection Act.

The FCRA imposes procedural requirements on employers that gather and use "consumer reports" to hire, fire, promote, demote, or reassign current or prospective employees. Consumer reports are defined broadly in the regulations to include background checks for employment purposes.
