Down Payment Assistance HUD Memo

On May 25, 2016, Deputy Secretary Nani Coloretti, of the U.S. Department of Housing and Urban Development (HUD), issued a memorandum representing management's decision and resolution of the present disagreement between the Office of Inspector General (OIG) and the Office of Housing-Federal Housing Administration (FHA) arising out of the OIG's audit of NOVA Financial and Investment Corporation (NOVA) and its origination of FHA-insured single-family mortgages for borrowers using down payment assistance provided by an Housing Finance Agencies (HFA).

Coloretti concludes that recent FHA guidance regarding down payment assistance, including a 2012 Interpretative Rule and Mortgagee Letter 2014-13, allows HFAs and other government entities to provide down payment assistance in connection with FHA-insured loans and "places no restrictions or prohibitions on how governmental entities raise funds for their down payment assistance programs." In addition, Coloretti determines that the two local HFA programs featured in the OIG's audit of NOVA do not violate FHA rules governing gift funds or "premium pricing."
