Project Updates:  BW's R. Amelia Harding House, League Park, and a Big Weight Shift on a Big Bridge

Fans of heavy civil construction and engineering can watch how contractors transfer the 45,000 pound load of concrete and steel from temporary supports to towers and cables on the new eastern span of the San Francisco Bay Bridge.

Home Energy Management Options

From Schneider Electric, the Wiser Home Energy Management System is one of the highest-rated of such options.  It has the added feature of communicating energy use data not just with the homeowner, but also with the utility, to permit comprehensive electricity demand management. We have been looking for such a system to use in our home. If you have experience with any, please let me know.

Legal Alerts Publicize Significant Rulings and Legislation

Through Frantz Ward's legal alert process, which involves both e-mails, our web site, blogs, and this e-newsletter, my colleagues published six important updates over the last several weeks.  They include: 

  • a summary of an Ohio Supreme Court case holding that a construction defect that has not caused resulting damage is not covered by insurance;
  • another summary of an important piece of legislation that, if enacted, would benefit employers;
  • an explanation of an NLRB decision that enhances union record-request powers;
  • review of an Ohio Supreme Court case that holds that the party suing to foreclose must hold title at the time of filing;
  • an alert about the new limitations period in place for breach of contract claims in Ohio; and,
  • an analysis of a settlement agreement reached by the EEOC relating to Family Medical Leave Act and Americans with Disabilities Act concerns for employees.

Seminars

On December 6 and 7, 2012, Andy Natale and I will discuss Risk Management as part of the Construction Employers Association's Project Manager Development Program. The five-part course, which is already underway, is designed for early-career project managers.  Course materials are available here

 

On December 11, 2012, Andy, Marc Sanchez and I will discuss Construction Defect Litigation during a telephonic seminar sponsored by National Business Instutite.  Program information is available here.

Blogs

Through the Ohio Environmental Law Blog, former Ohio EPA Director Joe Koncelik has published a thoughtful article discussing the implications of a second Obama term on environmental regulation.

 

Through their Labor & Employment Law Navigator, Rebecca Bennett  and Keith Ashmus have highlighted a recent NLRB ruling that obligates businesses to promptly provide even irrelevant information in response to union requests during the bargaining process.

 

Publications

On November 13, Keith Ashmus published an opinion piece in the Washington Post cautioning that, while attention now is on the Fiscal Cliff, pending regulatory changes may have a bigger impact on business.
