Deadline Issued for New FMLA  

Posting and Forms Requirements

 

The U.S. Department of Labor ("DOL") has issued revised Family and Medical Leave Act ("FMLA") forms and posting requirments.  

 

On March 8, 2013, employers covered by the FMLA must begin using the DOL's revised FMLA forms and the new FMLA poster in order to comply with the final FMLA regulations issued in February of this year.  

 

The modifications include an expansion of the law's military leave provisions, the implementation of changes enacted through the Airline Flight Crew Technical Corrections Act, and other changes to the prior regulations. The new forms expire on February 28, 2015.

 

  • All covered employers must display the new notice in a conspicuous location where employees and job applicants can see it.
  • The poster must be posted in all locations, even if there are no eligible employees at that location.
  • Electronic posting of the notice may satisfy the posting requirement, provided that it otherwise meets the requirements of the regulations.

Employers should also be mindful that family and medical leave obligations under state law may provide greater leave entitlement than the FMLA. In light of these changes, covered employers should review their existing FMLA policies to ensure consistency with the new regulations.
