In an effort to support your efforts to comply with the PREA standards, we are adding articles and supporting documents in our JD reCAP's until future notice. We will run through the PREA Standards sections to focus on the audit readiness. We will ask facilities to share policies, protocol and forms so others do not have to start from scratch. This week's edition will focus on Zero tolerance of sexual abuse and sexual harassment; PREA coordinator and Agency Planning.

 

We are hoping that ALL juvenile facilities pursuing PREA compliance will engage in open discussions to help each other in their efforts to gain PREA compliance. See Below!!!!

 

The VERA report on the European Prison Project

In 2012, Brinda Carol Penyak, CCAP Deputy Director was privileged to join justice experts from across the US in an opportunity to learn more about justice practices in Europe. This team was provided an opportunity to tour justice facilities and to explore practices influencing their countries' approach to crime. The findings from this endeavor are included in this report!

2013 National Symposium

The 2013 National Symposium on Juvenile Services held in Louisville, KY featured research on training and organizational commitment that was done in conjunction with Wilmington University's Doctoral student Christopher Spriggs. Please make sure your state is represented in this National Study by completing this 5 minute survey and FORWARDING it to anyone who should be represented in this research. Space is still Available in the Instructor Certification Course for Youth Mental Health First Aid (MHFA)

Monday, November 11 - Friday, November 15, 2013 in Altoona

 

Youth Mental Health First Aid is a public education program which introduces participants to the unique risk factors and warning signs of mental health problems in adolescents, builds understanding of the importance of early intervention, and most importantly - teaches individuals how to help a youth in crisis or experiencing a mental health or substance use challenge.  Mental Health First Aid uses role-playing and simulations to demonstrate how to assess a mental health crisis; select interventions and provide initial help; and connect young people to professional, peer, social, and self-help care.

 

The cost of this Youth MHFA Instructor Certification Course is $500.00 per person. This includes the 32-hour MHFA certification course, all course materials, meals, rental of training facility and continued follow up and support by the National Council for Community Behavioral Healthcare.

Individuals that become certified will be required to teach at least 3 classes per year in order to maintain their certification as a MHFA instructor. They will also be required to teach one community based class free of charge. This community class can be applied to the 3-course requirement to maintain certification.

PREA Resources

This week's PREA standard focus is on: § 115.311 Zero tolerance of sexual abuse and sexual harassment; PREA coordinator and Agency planning for PREA!

 

(b) An agency shall employ or designate an upper-level, agency-wide PREA coordinator with sufficient time and authority to develop, implement, and oversee agency efforts to comply with the PREA standards in all of its facilities.

 

(c) Where an agency operates more than one facility, each facility shall designate a PREA compliance manager with sufficient time and authority to coordinate the facility's efforts to comply with the PREA standards.

What are your responsibilities as a County Agency contracting for services?

§ 115.312 Contracting with other entities for the confinement of residents.

 

(a) A public agency that contracts for the confinement of its residents with private agencies or other entities, including other government agencies, shall include in any new contract or contract renewal the entity's obligation to adopt and comply with the PREA standards.

(b) Any new contract or contract renewal shall provide for agency contract monitoring to ensure that the contractor is complying with the PREA standards.

2. In accordance with Standards 115.12/112/212/312, what level of contracting monitoring is actually required by the contracting agency?

 

In years when the contract facility is audited, review of the audit report will meet the monitoring requirements. In other years, monitoring may be done in the same manner the agency verifies compliance with other contract terms, which may vary (e.g. on-site agency staff, inspections, documentation, etc.). Whatever monitoring method used should provide the agency assurances that the contractor is complying with the PREA standards.

The next JDCAP Standards Committee is Wednesday October 9 at 10:00 AM at the Abraxas Academy in Morgantown PA. During this upcoming meeting, we will review the Therapeutic Services standards.

 

The next JDCAP Training Committee meeting is scheduled for Wednesday November 13, 10AM-2PM at the Philadelphia Juvenile Justices Services Center. The training committee will be sent a proposed agenda in advance of this meeting.

 

Employment Opportunities

The Sentencing Project, a national non-profit organization engaged in research and advocacy on criminal justice issues, is seeking a State Advocacy Associate.  The position will primarily involve collaboration with an advocacy team to support state and local advocates engaged in juvenile justice reform. Issues to be addressed will include alternatives to detention and confinement, juvenile life without parole, sentencing policy reform, racial disparities in the juvenile justice system, and others consistent with the mission of The Sentencing Project.

OJJDP Bulletin Examines Intersection Between Delinquency and Victimization

The Office of Juvenile Justice and Delinquency Prevention (OJJDP) has released "Children's Exposure to Violence and the Intersection Between Delinquency and Victimization." This is the fifth publication in OJJDP's series on the National Survey of Children's Exposure to Violence (NatSCEV), which gathered data on the incidence and prevalence of children's exposure to violence across all ages, settings, and timeframes. This bulletin presents findings about the association between delinquency and victimization among children and youth ages 10-17 in the study. The study findings have implications for practitioners in the adolescent development and intervention fields.

 

Coordinating Council To Address Implications of Affordable Care Act

On November 13, 2013, from 10:30 a.m. to 12:30 p.m. ET, the Coordinating Council on Juvenile Justice and Delinquency Prevention will convene in Washington, DC, to discuss how the Affordable Care Act will impact vulnerable youth populations, including those youth transitioning from foster care or juvenile justice systems. Council members will also consider how best to disseminate information about the Act and its implementation to stakeholders. Chaired by the Attorney General, the council coordinates federal programs relating to juvenile delinquency prevention and missing and exploited children. Robert L. Listenbee, Administrator of the Office of Juvenile Justice and Delinquency Prevention, is vice chair.
