Q. What is Ohio's Comparative Negligence law? 

     

A.  In 1980, Ohio became the 35th state to enact a comparative negligence law.  The law applies to all negligence; however the insurance industry sees it most commonly with regard to auto accidents.  Comparative negligence allows both parties in the accident to share the cost of damages in proportion to their share of negligence, or fault.  For example, if you are involved in an auto accident and the other driver was 75% negligent, you would recover 75% of your damages.

The facts determined in investigating the accident as well as the police report and other considerations are taken into account in deciding an individual's share of negligence.  Should there be a disagreement regarding share of negligence, it may have to be settled in court.

Puppy and kitten season is here again. Although they are always cute and cuddly, finding loving homes for all is a challenge.  The Wayne County Humane Society has established a new spay and neuter fund with the goal of reducing companion animal overpopulation, keeping adoption fees affordable, and finding loving homes for all animals that pass through the shelter.   Donations may be made through their website www.wchs.org or by mail.

Who is at Risk

of Flooding? 

 

The abundance of rain we have had this spring has certainly been a cause for concern, although most of us who do not live in a flood prone area are under the impression that we are not at risk of suffering damage from a flood.   

 

The truth is that a flood loss can happen to anyone - whether their home or business is located in a high risk flood zone or not.  In fact, flooding is the nation's #1 natural disaster.  Floods can be caused by a number of factors, such as heavy rainfall, melting snow, hurricanes, broken water mains, inadequate or overloaded drainage systems and more.  According to FEMA (The Federal Emergency Management Agency), nearly 25% of all National Flood Insurance Program claims come from outside mapped high risk areas (see http://www.fema.gov/national-flood-insurance-program .)

 

Since flood damage is not covered under homeowners or commercial property policies, a separate flood insurance policy through the National Flood Insurance Program is needed to provide protection from financial loss due to flooding.  A flood policy provides important coverage for this type of loss, but there are some significant differences between a flood policy and traditional property insurance policies (i.e. Homeowners, Businessowners, Commercial Package Policies) that you should be aware of.  Here are some examples of these important differences:

1.  There is usually a 30 day waiting period before coverage goes into effect.

2.  Some items are only covered for their Actual Cash Value (ACV), not Replacement Cost (RC).  Examples include: carpeting and personal property.   

3.  A flood policy does not provide coverage for temporary housing.

4.  A flood policy does not provide coverage for financial losses due to business interruption.

5.  Deductibles will apply separately to building and personal property claims.

6.  A flood policy has coverage limitations in areas below the lowest elevated floor and in basements.  Examples of items not covered in this area include: paneling, carpeting and other floor covering, drywall, clothing, furniture, electronic equipment and kitchen supplies.

7.  Homes may be insured to a maximum of $250,000 for the building itself; and $100,000 for contents.

8.  Non-residential buildings and contents also have maximum coverage limits.

 

Anyone in a community participating in the National Flood Insurance Program may buy flood insurance, and if you live in a low to moderate risk area, a flood policy is more affordable than you may think.  Relying on Federal Disaster Assistance after a flood (instead of purchasing flood insurance) is not a good idea because floods are not always declared a federal disaster, and aid is typically a loan which must be repaid with interest.  Furthermore, if you receive disaster assistance, you must purchase flood insurance to be eligible for future disaster aid.

 

There is no doubt that our weather patterns in recent years have been more volatile - definitely a good reason to consider adding flood insurance to safeguard your financial well-being.  For more information or a quote, please give us a call.

Before You Go On Vacation 

 

Summer Vacation time is here again!  Follow these tips to keep your home safe while you are away.

 

1.  Lock doors and windows.
2.  Install light and even radio timers to go on at various times. 
3.  Have neighbors pick up mail and newspapers, or have delivery temporarily stopped.
4.  Turn off the water supply to washing machines and toilets.
5.  Make sure your sump pump is working.
6.  Unplug televisions, computers and microwaves.
7.  Never leave a spare key hidden near your door.
