Employer Mandate Delayed Again for Some Companies Until 2016

The U.S. Treasury Department announced yesterday that it would postpone enforcement of a federal requirement for medium-size employers to provide health insurance to employees and allow larger employers additional time and more flexibility in how they provide coverage through a "phase-in" approach.

The requirement that employers with 50-99 workers provide health insurance coverage has been delayed until 2016, offering medium sized businesses an extended time in which to comply with the mandate before penalties for non-compliance are assessed.

For larger businesses having 100 or more employees, the requirement to offer health benefits will be put into effect gradually. Employers in this category must offer coverage to 70 percent of full-time employees in 2015 and offer coverage to 95 percent beginning in 2016, or face stiff tax penalties.

The employer mandate was originally scheduled to take effect in January of 2014.  Last year, that was delayed until January of 2015, and this most recent delay pushes back enforcement an additional year until 2016.

For more information about the employer mandate, the recently announced penalty delay, and how this delay may  affect your business, please contact Jamie Debenham at (440) 238-5454.
