Breaks or Consequences!

It's natural for people who are serious about their work to want to continue working to see something through in spite of what the clock says.  These are exactly the kind of people we look for to send to you on assignments.

While a strong work ethic is one of the best attributes an employee can have, an employer who ignores legal mandates regarding breaks is asking for trouble.  Non exempt employees must take breaks in accordance with legal requirements.  There are no acceptable excuses, even if the employee insists on completing a task before taking a break.

Did you know the #1 labor problem leading to litigation is failure to comply with legally mandated break times for non-exempt personnel?  Do all your managers understand the importance of insuring timely breaks for non-exempt employees?

We at BOLT are revising our time cards to give us clear visibility and insure that our employees are in compliance with these laws.  You can expect to see them in the next few weeks. We will also be advising all our employees of the legal requirements regarding breaks.

Changes to FAQs Muddy Waters

January 23, 2012 the California Division of Labor Standards Enforcement issued revised Frequently Asked Questions regarding a law that became effective January 1.
The revised FAQs were issued in response to criticism from, among others, the staffing industry.
In sum, the law intends to require employers to advise employees of rates of pay at the time of hiring.

There is much confusion about who is the employer in staffing agency's relationship to their clients, as well as when and what information must be disclosed.

To get to the point for you, our client, we are following these events and providing information to our employees at the time of hiring and documenting accordingly.

If it's appropriate, we will also advise and document the information prior to dispatching a temp to your workplace. (More)
