Your DPBA has has been in email correspondence and has met with Sgt. Scalise. OCSD, DP Harbor Patrol regarding enforcement of the sandbar at the outer jetty of Dana Point Bar near the Ocean Institute (aka "Danalina"). In time for the upcoming Labor Day Weekend we want to provide boaters the latest information regarding enforcement at Danalina form Sgt. Scalise, DP Harbor Patrol.
We received an email from Sgt. Mike Scalise earlier this week. Below is that email, as we received it, including the yellow highlighting.

We are still waiting on an official date for the dredging of the sand bar area so no signs have been placed. Here is some verbiage that I have collected on this topic. Please feel free to use what you like. We at the at the Harbor Patrol truly wish that people come down to Dana Point and enjoy their stay and have a safe time doing so. The increased popularity of the sand bar has prompted us to start enforcing some of the rules and regulations that have been in place for many years. These rules are more likely to be strictly enforced on busy weekends or holidays that create higher traffic and more safety concerns.
The following section is the general rules for Dana Point Harbor and lay out some of the issues with the sand bar. These do's and don'ts are great for everyone to know about. For Other issues such as open containers or dogs running off leash in the water are common laws throughout the county and are self-explanatory. This may be a good starting point to post in your bulletin. Feel free to post my email along with this information for people to reach out with any questions. I will cc you guys on all responses. Sec. 2-2-204.
- Designation of special-use area-Dana Point Harbor.
(a) Description. For purposes of this section, the area shown on exhibit "A," consisting of all of the water portions of Dana Point Harbor lying westerly of the seaward side of the east jetty and northerly of the seaward side of the main breakwater, including harbor entrance area northerly of the main breakwater to the easterly jetty, but not otherwise including the waters of the Pacific Ocean which lie on the seaward side of those structures is hereby designated as a special-use area; only those uses which are set forth within this section or otherwise established by resolution of the Board of Supervisors shall be permitted within said Special-Use Area of Dana Point Harbor.
(b) Permitted Uses. Within said special-use area, only the following uses are permitted:
(1) Operation of documented or registered boats and other vessels within marked navigation channels.
(2) Use of swimming aids, including windsurfing boards and surfboards, subject to regulations which may be established from time to time by resolution of the Board of Supervisors to enhance public safety and recreation within the special-use area.
(3) Anchoring and mooring of boats and other vessels within designated anchorage areas and in accordance with section 2-2-66 of the Codified Ordinances of the County of Orange.
(4) Regattas, parades and similar single-occasion events are permitted only with a valid marine event permit issued by Sheriff's Harbor Patrol, Harbormaster or his/her designee.
(5) Other marine-oriented recreational and educational activities and events, as established by resolution of the Board of Supervisors.
(c) Prohibited Uses. The following activities are prohibited within the special-use area:
(1) Swimming or wading, including use of swimming aids within any area not so designated by resolution of the Board of Supervisors as set forth in (b) above.
(2) Any commercial use within the special-use area which is not specifically authorized by the Board of Supervisors or is approved by the Director or designee, or otherwise operates under a duly executed license or permit issued by the County.
(3) Launching of any motorized watercraft at any location other than the Launch Ramp.
(4) No person shall fuel any vessel with any petroleum product directly from portable tanks along or adjacent to the jetties.

In closing, a bit of good news: There's a not yet confirmed humor around, heard on multiple occasions lately, that the next Harbor dredging is on for this winter; subject to approval of all necessary permits. We'll advise officially when this rumor has hopefully been confirmed.
