Entrepreneurs:

Five things you should know before starting your business.

It is easy to be confused by the excitement and novelty of new prospects, so be sure to stay aware of the legal implications before making your next move. Entrepreneur magazine names the following as the top five mistakes entrepreneur's make:

 business handshake

1. When making a deal, put it in writing. It is easy to get wrapped up in others' good faith during the early phases of a new transaction. It is best for all parties involved to have a clear road map of expectations.

2. Choose the appropriate business structure. Consider the state you are in, ownership, cost, maintenance, tax and legal liability.

3. Make sure when entering partnerships that there is a written agreement with clear details.

4. Be aware of stipulations and risks associated with entering a 50-50 partnership. An LLC format offers more flexibility if changes are necessary.

5. Conduct a trademark search to verify whether or not similar trademarks exist. to prevent being sued for trademark infringement.

Keeping these tips in mind can prevent fallouts and unwanted costs. Protect your new business from simple and costly mistakes.

A Woman's role in Estate Planning

Women armoney keye taking over many roles in their work, their relationships and within their families. Another area that still needs attention from women is the family finances and ensuring plans for their children. Estate planning is still dominated by men, but more women are taking initiative to plan appropriately as women realize how certain statistics could affect their futures.

One such statistic is that, on average, women live longer than their male counterparts and women 65 or older are three times more likely than men to be widowed. This is a good reason why estate planning should be a substantial part of a retirement plan for women.

A few factors to be aware of and some questions you may want to ask yourself when beginning or revising a trust will include: who will take care of your children? Is there money available to share or divide? What deadlines are involved?

These factors will be important to think about when considering the future for your family and loved ones. Women need to feel empowered to start discussions and make decisions.

Men and DIVORCE

divorce rings

While prejudice exists in many facets across different groups, most people hesitate to consider men victims of discrimination. When it comes to divorce, however, men are often ruled out of more time with their kids. There are examples where both parents are in identical situations with regards to their time management, work, and finance, yet in some cases dads still have to fight to get their fair share of time with the kids.

Dads are battling a war on stereotypes. Women are considered to be more nurturing and better qualified to receive more responsibilities for their children. Family courts are just plain unsympathetic to men; decisions are based on probability and statistics backing previous decisions in favor of women. From splitting time to expectations related to child support, men are held to a much different and more difficult standard.

It seems that in these times, discriminating against any one group for any reason would be a thing of the past. Many are under the impression that men are a privileged group and don't deserve the same consideration in family law cases, when it is simply untrue and unfair.

Helping Make a Difference

While we pursue our professional goals, we also endeavor to improve the quality of life in our communities.  We make significant contributions to causes and charities important to us and our families and friends.

As donors for Susan G. Komen for the Cure, we at the Law Offices of Michael Kuldiner encourage our readers and friends to participate in promoting Breast Cancer Awareness Month.

There are many things you can do to get your community involved in this organization; one way is to ask your employer about participating in the Promise Action Campaign. Companies who join make pledges to do something in return for employees getting screened.

Major corporations are involved in this campaign to promote early detection; recent studies show that half of women with insurance did not get their annual mammogram. This program hopes to initiate conversation and create partnerships in awareness and health.

Halloween Safety Tips

With October underway, children (and many adults) have begun planning their Halloween costumes and events. While this is a holiday intended to be full of sweets and treats, there are always a few minor threats to be aware of. Here are some tips to make sure your children are safe while haunting the neighborhood or attending parties.

  1. Parents should pay close attention to the houses their children approach and be sure to monitor situations where children are invited inside for their treats.
  2. Parents should reference websites listing l
ocal sex offenders before sending children to a friends' neighborhood. Visit http://www.pameganslaw.state.pa.us/ for more information.
  3. Make sure your child is confident about crossing streets.
  4. Consider your child's costume and accessories - make sure there isn't a chance that he or she could trip and fall or hurt themselves with handheld props.

Lastly, if your child is pressuring for permission to trick-or-treat all over town and you're feeling apprehensive, suggest throwing a party at home and invite all of his or her friends and family. Make a haunted house, decorate the garage, and of course supply lots of candy!
