Divorce Rate on the Rise

 

The year 2010 saw a significant rise of divorce cases at our law firm.  One aspect of these divorce cases that can often be overlooked are the best interests of the child.  Often times, they are caught in the cross fire of battling spouses.  Family law has become an extremely complex legal process.  Over the past few years, attorneys of the Law Offices of Michael Kuldiner, P.C., have cultivated significant experience in complex family law litigation and have been successful in helping families.  Family law proceedings often involve child custody disputes.  While many collaborate and try to work things out in a civil way for the kids' sake, quite often, couples engage in litigation which can involve harsh accusations.  When it comes to child custody litigations, we emphasize to our clients to focus upon the best interests of the child, and create custody schedules that meet not only the needs of each parent, but the needs of the child.

 

 

Custody Law Revisions

Protecting the children    

 

A recently passed Pennsylvania House Bill provides for major revisions in the state's child custody law.  It provides Courts with an extensive list of factors that must be considered when awarding custody with the intent of keeping the interests of the children at the forefront.  In addition, grandparents are awarded more rights and tougher measures have been put in place against parents who violate custody agreements. The changes are meant to make court hearings less argumentative, and protect the best interests of the child.

 

Under the new legislation, the court will have to consider the following factors when determining custody matters:

1) which adult party is more likely to encourage and permit frequent and continued contact between the  child and the other adult party

2) the parental duties performed by each party on behalf of the child

3) the need for stability and continuity in the child's education, family life and community life

4) the availability of extended family

5) the child's sibling relationships
