Capitol update on transportation & property rights

GOOD BILL ALERT
Rep. Cindy Burkett's bill (companion to Sen. Lois Kolkhorst's bill and similar to Sen. Bob Hall's bill) to make toll road traffic forecasts available to the public had a hearing this week in the House Transportation Committee. But toll agencies, the NTTA and RMAs, want to keep the data SECRET from the public until AFTER the deals are signed (when it's too late to change the outcome).

HOUSE TRANSPORTATION UPDATE
YOUR CALLS ARE MAKING A DIFFERENCE!
Thank you for making phone calls last week. At least one of the three bills we're asking to get voted out of committee did get voted out last week, HB 565, to strip private toll corporations of their power to wield eminent domain. Two other great bills authored by Rep. Cindy Burkett are still going nowhere in the House Transportation Committee. We're also going to add another key bill this week to our action item call list: HB 1835 by Scott Sanford to prevent our existing freeway lanes from being converted into toll lanes (and our free lanes being downgraded to frontage roads).  
  

DO NOT ASSUME SOMEONE ELSE IS MAKING CALLS (so you don't have to)! It's critical that everyone to do their part to ensure our reform bills pass this session.

HOUSE ACTION ITEM
 
1) Contact House Transportation Committee Chair Joe Pickett and ask him to vote these bills out of committee - (512) 463-0596 (email here)
2) Then call YOUR State Representative and ask him/her to speak to the members of the Transportation Committee to support these bills and vote them out of committee.

'Pass HB 572 & HB 528 to subject toll authorities to sunset review out of committee. Also pass HB 1835 to protect Texans from having existing freeway lanes converted into toll lanes. We expect and Texans deserve these long-needed toll road reforms.'

SENATE TRANSPORTATION UPDATE
The committee heard and voted out Sen. Bob Hall's bill, SB 714, to ban red light cameras. The full senate also passed Sen. Lois Kolkhorst's eminent domain bill, SB 474, to have landowners recoup their legal costs if the condemner low-balled their offer and was off by more than 20% from what the court ultimately settled on, as well as Bob Hall's SB 444 to strip the private toll corporations of eminent domain authority. The senate also passed SB 1237 by Sen. Van Taylor to make MPOs have to broadcast their meetings over the internet and archive them so the public can more easily watchdog what they're doing.

BILLS UP THIS WEEK
Rebellion in the Senate!
After the Lt Gov. Dan Patrick asked his Senate Transportation Committee Chair Robert Nichols to set our KEY reform bill for a hearing this week, SB 485, by Sen. Lois Kolkhorst to take the toll off the road when it's paid for, Nichols posted the meeting notice WITHOUT SB 485 on it. Most of the senate bills up this week have little consequence. However, one bill we need to oppose.

SB 1919 by Sen. Kirk Watson will allow TxDOT to start imposing variable speed limits on our highways. TxDOT did a test run on Loop 1604 in San Antonio last year, and it was an unmitigated DISASTER! The normal posted speed limit is 70 MPH, but TxDOT had set it down to 20 MPH during the middle of the day when there's NO congestion and no need for any additional caution. Hence, TxDOT CREATED congestion where there normally isn't any. So we already know what TxDOT will do with this authority - they'll create congestion to force their toll roads down our throats!

SENATE BILL ALERT: SB 1919
Fill out a card at the back of the room to OPPOSE SB 1919 by Sen. Kirk Watson which would give TxDOT the authority to impose variable speed limits.

Turn-in your Witness Registration Form to the clerk at the front of the room. Even if you don't want to testify, registering for or against a bill greatly helps. Unfortunately, we cannot get our support for or opposition to a bill on the official record unless you're physically present in Austin when public testimony is open on the bill.

HOUSE BILL ALERT: HB 3634, HB 3593, HB 2619, HB 527, HB 1889
Register for House bills at the iPad kiosks outside the committee rooms. Be sure you press 'ok' to finish at the end to ensure your positions are indeed registered.

OPPOSE HB 3634 by Rep. Ron Reynolds to impose a 5 cent per gallon LOCAL tax on natural gas for alt fuel vehicles. This tax money would go exclusively to cities to pay for traffic signals and local roads not to state highways. A good portion of roads within cities are state highways and if alt fuel vehciles are to be taxed for their road usage, it needs to be a statewide solution, not just a local one.

SUPPORT
HB 3593 (Burkett) - To require all toll entities and transportation boards like MPOs to broadcast their meetings on the internet and archive them so citizens can more easily watchdog what they're doing.

HB 2619 (Burkett) - Companion to Kolkhorst's bill to allow landowners to repurchase their property from a toll entity if they do not use it within a certain timeframe.

HB 527 (Larson) - To require a countywide public vote on any light rail/street car proposals by the transit authority in Bexar County.

HB 1889 (Metcalf) - To prohibit any high speed rail in Texas.

GRIMES COUNTY
TxDOT gets county to reverse its position opposing Loop 249 toll

Very bad news... 
TxDOT successfully lobbied the Grimes County Commissioners Court to RESCIND its previous resolution OPPOSING the SH 249 Toll Road and they passed one in favor of it!
 
Gary Husfeld was appointed to replace Pam Finke as Precinct 4 Commissioner. When running for this office in 2014, Mr. Husfeld expressed an opinion that the SH 249 Toll Road was "a bridge over Grimes County." Yet he voted in favor of the toll road.
 
TxDOT intimidated Grimes County into accepting the SH 249 Toll Road by threatening to either build the road without frontage roads, or to build it into Grimes County and dump the traffic onto FM 1774 and make no road improvements to handle it. County Judge Ben Leman headed up the effort to persuade the individual county commissioners to change their vote. He is also putting pressure on the Iola and Anderson town councils to rescind their resolutions.

The Capital Area MPO (CAMPO) will vote to add toll lanes on MoPac south from Cesar Chavez to Slaughter Lane at its meeting Monday, May 11. It'll also vote on its long-range plan known as the 2040 Plan. This plan includes converting auto lanes into bus-only lanes, tolls on I-35, and a host of wasteful projects. Plan to attend to get your opposition on the record.

The Alamo Area MPO (AAMPO) will be holding a public 'Listening Session' to gather public feedback on its federal re-certification. This is the public's chance to give them an earful about the unresponsiveness of the MPO to the public's concerns about toll roads, how the board is stacked with elected officials who do not represent the areas to be tolled (and those who do are outnumbered), and how too many unelected appointees have votes on the board and hence are not accountable to the people!

It would also be a time to say their meetings are ALWAYS during the day when the public is at work and downtown far from where the areas to be tolled are. Their meeting location is inaccessible due to NO PARKING except the reserved spaces for the board members.
