Fire Sprinkler Disclosure in Leases Q&A
The CTR Legal Hotline received calls from several members after providing information in the last e-newsletter that the new fire sprinkler disclosure statute requires all residential leases to disclose whether or not there is an operative fire sprinkler in the dwelling unit and if yes, the date of the last maintenance and inspection. Under the statute, this disclosure must be in all residential leases where a dwelling unit exists, effective as of October 1, 2015. Below are the answers to the most frequently asked questions we have received about this new requirement.
1. Is there a requirement to install a sprinkler? There is no requirement in the new sprinkler bill to install a sprinkler. The only requirement is to include a notice in the lease whether there is or is not an operating sprinkler system in the unit.
2. Where does the sprinkler need to be located in the unit? Again, the only requirement is to include a notice in the lease whether there is or is not an operating sprinkler system in the unit. Location of the working fire sprinkler system is not part of the statute requirement.
3. What language do we use to say there is no sprinkler in the unit? The following language is recommended to comply with the sprinkler law to notify that there is no operating sprinkler in the unit: "Landlord hereby puts Tenant on notice there is no operating fire sprinkler in the unit." [Please note, per the statute this needs to be in size 12 font, in bold, and in the same typeface as the rest of your Lease]
4. Will CTR be updating the Lease available at the CTR site and on Zipforms? CTR is in the process of updating the Lease to reflect the new changes in the law that takes effect October 1, 2015. We will announce once that updated lease is available at our website.

Other highlights include a National Association update from 2016 NAR Region 1 Vice President Kevin Sears and an entertaining post-awards banquet bowling party at High Rollers Luxury Lanes & Lounge.
