Department of Consumer Protection Reconfirms Guidance Regarding the Residential Property Condition Disclosure Report

The Legal Counsel for the Department of Consumer Protection (DCP) has reconfirmed certain guidance related to use of the Residential Property Condition Disclosure Report (RPCDR). Effective July 1, 2012, a statutory change increased the penalty credit for failure to provide the state-mandated RPCDR from $300 to $500. Until the DCP issues a new form, which has not happened yet, DCP indicates it is acceptable to: (a) use the version of the RPCDP that is posted on the CTR site that solely changes the amount of the penalty to reflect the correct amount ($500) along with notation of the revision date; or (b) cross out the $300 on the RPCDR and write $500, and have the seller initial the change. Note: "acceptable" means there is no enforcement action that would be taken against a licensee who accurately reflects the $500 amount rather than the $300.

The DCP has also confirmed that it also is permissible to download or distribute the version of the form that remains posted on their DCP site, with the $300 amount (without any change or notation about the $500); but the $500 is still the penalty credit. CTR's guidance continues to be to use a form indicating the $500 to provide the seller with information about the actual penalty credit amount.

 

REALTOR� Magazine Seeking Nominations for 2014 Good Neighbor Awards

REALTOR� Magazine's Good Neighbor Awards recognize REALTORS� who have made an extraordinary impact on their community, or on the national or world stage, through volunteer work. Five winners are announced each fall in REALTOR� Magazine. Winners are recognized annually at the REALTORS� Conference & Expo, and receive $10,000 grants for their charities. Winners also receive travel expenses to the conference and national and local media exposure for their community cause. In addition to the winners, five honorable mentions each receive a $2,500 grant. This year's Good Neighbor Award deadline is May 16, 2014. Nominations are received from REALTORS� around the country, as well as through local and state Good Neighbor Award programs that serve as feeders to the national program.
