Do Your Non-Compete and Non-Solicitation Agreements Reach Social Media Posts?

Social Media sites like LinkedIn and Facebook have become the source of much attention for human resources professionals, business owners and employees alike. They have also drawn the attention of the NLRB and the EEOC. The message is clear: social medial is a tool that can be both beneficial and problematic for employers. Moreover, the law is still playing catch-up with the emergence of social media. One such area that is extremely undeveloped is the use of social media as a source of unfair competition. One recent case out of Massachusetts serves to highlight how this issue might play out.

Shouldn't All Candidates Be Asked If They Have Been Accused of Harassment?

Our defense of sexual harassment cases has led us to review the psychological underpinnings of the harassment scenario and how childhood experiences may lead to personality disorders, sexually compulsive behavior or sexual addiction. While the scientific community is reluctant to endorse the concept of sexual addiction because of the potential criminal defense that diagnosis might provide to rapists and child molesters, our practice has reviewed sufficient psychiatric/psychological records over 2+ decades to allow us to conclude that some individuals compulsively and repeatedly engage in self-destructive sexual activity, including sexualizing the work environment and commencing affairs at work.

At the Auburn Hills Chamber of Commerce Silver & Gold Awards last Friday, Bill Pilchak was named Board Member of Year for 2013.  Bill is a past Chairman and has served two terms as Vice Chairman during his five years on the Board.  He was honored to have been selected, given the quality of his peers on the Board, including representatives from Chrysler, Delphi, Palace Sports, and Oakland University and other dynamic businesses and institutions.  An especially gratifying part of the program involved an explanation of which current Chamber endeavors are the result of or an evolution of an idea first presented by Bill.  As shown in the photo, a trophy signifying the honor will be displayed in P&C's lobby for the coming year. 

 

Community involvement has always been important at Pilchak & Cohen and it is nice when the resulting after-hours and weekend work results in recognition.  Last year, the firm was honored with the Oakland County Bar Association's Leon Hubbard Community Service Award in support of diversity for its Law Day Program at Rogers Elementary School and College Scholarship for Rogers students graduating high school.
