"Fun Day" Cases - What Happens When an Employee is Injured During a Company Event? [North Carolina]
Many companies sponsor athletic events, parties, fundraisers, retreats, and similar activities for their employees. In what have become known as "Fun Day" cases, courts have addressed the issue of whether injuries that occur at company-sponsored events are compensable under the N.C. Workers' Compensation Act.
The general rule for determining the compensability of injuries suffered by employees at these types of events is that injuries will NOT be found compensable if the employer invited its employees to the event but did not require attendance.

Georgia Employers: Have you posted your required Pink Panel of Physicians?
A Posted Panel of Physicians is a list of physicians that workers are required to visit for treatment if injured on the job.
In Georgia, employers are required to post a "Panel" of physicians in an area accessible to all employees (posted in breakroom or near time clock) as part of their workers' compensation insurance.
This Panel is often printed on a piece of pink paper (approx. 8 ½ x 14 inches). In order for the "Panel" to be valid, the law in Georgia requires the following:
-
A minimum of six physicians listing their name, address and telephone. -
Of the six, at least one should be an orthopedic physician. -
No more than two of the physician groups should be "industrial" clinics.
To ensure Georgia employers are in compliance, FFVA Mutual mails out a panel for posting. To learn more, click here to go to the GA State Board of Workers' Compensation.

In-House Fraud Unit Wins Conviction
While employed as a technician for an electric company, a worker was involved in an auto accident and reported low back and lumbar area injuries. This was a compensable claim. Surveillance performed by one of FFVA Mutual's approved surveillance companies showed the claimant working on a personal side business (lawn maintenance) while being paid work comp benefits and not documenting lawn maintenance income on DWC-19 forms.
FFVA Mutual's in-house Special Investigations Unit (SIU) reported to the Division of Insurance Fraud and, as a result, the injured worker was arrested, pled guilty to one felony count of Insurance Fraud and agreed to pay restitution of $10,000. FFVA Mutual takes fraud seriously, to report a potential fraud, email: Fraud@ffva.com |
