Tennessee General Assembly Modifies Punitive Damages Statute
Regarding Vicarious Liability
Effective July 1, 2013

Tennessee Code Annotated, Sec. 29-39-104(g)

 
Vicarious Liability assigns responsibility for an injury to a person who did not cause the injury, but rather has a relationship with the person who did.
  
The new law states that punitive damages may be awarded against an employer based upon the acts of an employee if it is proven by clear and convincing evidence that:
  • the act was committed by a manager while in the scope of employment;
  • the employer was reckless in hiring or training the employee and that recklessness caused the injury; or
  • the employer authorized the act disregarding that there could be an injury.
