EEOC Ruling on Wellness Programs under ADA and GINA
The Equal Employment Opportunity Commission (EEOC) issued a final ruling on May 17th clarifying how employers' health and wellness programs can be designed and administered to comply with the Americans with Disabilities Act (ADA) and the Genetic Information Nondiscrimination Act (GINA).

At a Glance:
  • A voluntary wellness program may offer incentives of up to 30% of the total cost of self-only coverage.
  • An employer also may offer an incentive of up to 30% of total cost of self-only coverage for an employee's spouse to provide information about their health status.
  • Employers must notify participants about the medical information a program will collect and how it will be used and protected from disclosure.
  • EEOC will not deem a wellness program voluntary if it requires employees to participate, denies or limits coverage for non-participation, or coerces employees to participate.
  • Smoking cessation incentives can be no greater than 30% of the total cost of self-only coverage if they involve testing for nicotine or tobacco.
  • Notice requirement and incentive limits apply as of the first day of the first plan year that begins on or after January 1, 2017.
