In Politics, Nothing Gets Done Until You Scream Real Loud, and the OCC is Here to Scream    

   

As you know, many trial courts around California have been forced to close courthouses and layoff trial court employees.  LA County alone has closed 10 of its 48 Courthouses.  Now, the Open Courts Coalition ("OCC"), a bipartisan group comprised of attorneys, the business community, labor, former legislatures, and retired judges, whose sole focus is advocacy for adequate court funding, is making a lot of noise to convince, if not compel, the members of the California Assembly and Senate to support reinvestment in our court system.  We will keep you informed of their progress. 

 

While the protests and arguments against court closures heat up, the  new Amendments to UCC Article 9, including the revised filing forms become effective on July 1, 2013.  In this issue we examine further the drivers's license rule for determining the name of the Debtor, tips about using the new forms and the legislative status of the Amendments in the various states.  We also, take a look at last week's crack in the traditional rule that student loans are not dischargeable in bankruptcy.
