New Fraudulent Schemes Abound As Promises Are Made to Owners in Foreclosure That Their Property Can Be Saved 
By promising to help distressed homeowners fight foreclosures, alleged modification specialists have extracted thousands of dollars in supposed legal fees from consumers who ended up losing their homes anyway. The California State Bar has received nearly 12,000 loan modification complaints. Homeowners, Banks and other mortgage lenders are cautioned to pay close attention in determing these schemes.

The Court of Appeal for California's Fourth Appellate District recently held in Weingarten Realty Investors v. Chiang,(Cal. App. 4th, December 19, 2012) that any persons who claim an interest in unclaimed property, such as an assignee, may apply for and recover the property under section Code of Civil Procedure Section 1540[1].
