Make a New Years Resolution to get your estate plan in order.

Getting fit, eating healthy, working out and spending more time with friends and family are great goals but how will you address real issues and cover what happens if you don't have a Will, Living Trusts; Health Care Proxies, Estate Plan in order?

Change is constant...

The beginning of a new year is the perfect time for you to look over your estate planning documents and make sure everything is according to your wishes, particularly as affected by the previous year's events.

So where do you start? If you have not begun your estate planning, please give us a call at Tindall Law Service and schedule an appointment to review your options. If you have some planning completed already, consider reviewing and updating your documents. You should consider not only the property and assets that are being distributed, but also the people in your life that are involved. 

Always carefully consider beneficiaries and those with whom you have entrusted other responsibilities, including the executor of your will, trustee of a trust, power of attorney, and especially the guardian of your children or loved ones.
When reviewing your documents should you be looking for what needs to be updated in your estate planning documents? Review the items below that may cover some possible events and circumstances that could require changes in your will or other estate planning documents:

1. Marriage Changes. Did you, one of your children/grandchildren, or another family member named in your documents get married this past year, or since your documents were originally prepared?
2. Divorce. Have you, one of your children, or another family member that was named in your documents get divorced?
3. Was there the birth or adoption of a child, grandchild? Has your family grown? Births and adoptions are a common reason to update your estate planning. Have you named a guardian for your children in case of your death?
4. Has one of your beneficiaries reached the age of majority? The years can pass quickly. If you created your estate plan before some of the minors included have come of age, maybe you want to reconsider some of the planned distributions. Has anyone reached a milestone set in your estate plan?
5. Was there a death or serious illness in the family? Has one of your family members or someone named in your estate plan died or fallen seriously ill this past year? This question is especially important if it's someone who has been named as your executor, power of attorney or trustee?
6. Were there relationship changes with people, pets or organizations included in your estate plan? Did one of the organizations your support close its doors? Do you have a new relationships persons or organizations that you would like to include in your planning? Alternately, have you severed any such relationships?
7. Did you purchase or complete the sale of any major assets? Simply stated, have you bought or sold a house, investment property, opened or closed a business, etc.?
8. Have you contracted any new insurance policies or pension plans? If you changed jobs or acquired a new insurance policies or pension plans, for you or your spouse, you may need to make an adjustment of beneficiaries in your estate plan? Another item to consider is if you reached the age at which you are required to take distributions from a pension plan?
9. Did you move this past year or change of your state of residence? Moving out of state or country could have inadvertently made part of your estate plan invalid.
