Nebraska Beef Fined $61,084: Electrical Safety

LEXINGTON, NE:  

 

The U.S. Department of Labor's Occupational Safety and Health Administration has cited Nebraska Beef Ltd. with eight safety violations, including one repeat, for failing to guard open stairs and platforms to prevent a fall hazard at its Omaha beef processing plant. Proposed penalties of $61,084 resulted from the November local emphasis program inspection for high-hazard general industry establishments, as identified by injury and illness rates in Nebraska.

 

"Nebraska Beef has a responsibility to recognize the hazards that exist in the workplace and to install barriers, signage and make appropriate repairs to ensure a safe working environment," said Bonita Winingham, OSHA's area director in Omaha. "Employers who are cited for repeat violations demonstrate a lack of commitment to employee safety and health."

The repeat violation was cited for failing to provide standard railings and toe boards on open-sided floors and platforms 4 feet or above an adjacent floor or ground level. This violation was noted on a crossover platform in the scale room. A repeat violation exists when an employer previously has been cited for the same or a similar violation of a standard, regulation, rule or order at any other facility in federal enforcement states within the last five years.  

 

A similar violation was cited in 2011.  Seven serious violations were cited for failing to post warning signs indicating permit required confined spaces, use lockout/tagout devices for purposes other than controlling energy sources, and provide an eyewash station and a clear path to safety showers for employees exposed to corrosive chemicals, such as bleach, and properly adjust machine guarding. Three of the violations involve electrical safety standards, including operating machinery with visible electrical hazards, such as broken wires and damaged junction boxes, and failing to cover outlet boxes and use permanent wiring instead of flexible electrical cords.  

 

A serious violation occurs when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known.

  1. Identify the hazard and implement engineering controls to mitigate those hazards where possible.  
  2. When possible create an electrically safe work condition.  
  3. Establish boundaries to keep all workers safe from shock and arc flash.
  4. Have an up to date one line diagram.  
  5. Do not take short cuts.  
  6. Inspect the equipment for installation condition before each task.  
  7. Conduct a job hazard risk analysis before each task.  
  8. Test the meter before each use on a known live circuit of the same voltage to be tested.  
  9. Inspect and wear the appropriate arc rated PPE for all tasks when live voltage is involved.  
  10. Inspect and field test electrically insulated gloves before each use.  
  11. Have the arc rated insulated rubber gloves dialectically tested every 6 months as OSHA requires.  
  12. Remove all metal objects such as tools, pens, jewelry or keys from your daily wear before donning arc rated PPE .  
  13. Use arc rated insulated tools ALWAYS when working with live equipment.  
  14. Receive up to date arc flash and personal protective equipment awareness training not to exceed three years as the standard requires.  
  15. Use the "Left Hand Rule" - Proper Disconnect Operation
    • Stand to the right of the switch, not in front of the box.
    • Grab the disconnect with your LEFT hand.
    • Turn your body and face away from the switch.
    • Close your eyes.
    • Take a deep breath and hold it.
    • Then "throw" the disconnect lever

Worker without FR clothing dies in flash fire 

J.R. Resources cited for violations

A natural gas company's failure to provide a worker with FR Clothing led to a fatality, according to OSHA, which has cited Pennsylvania-based J.R. Resoures for eight safety and health violations.

The employee died from injuries sustained during a flash fire.

The company's seven serious violations include failing to:

  • require and provide flame-resistant clothing be worn when working around natural gas
  • provide fall protection from stairs on brine tanks
  • provide a written hazard communication program and training
  • properly label tanks and prevent workers from riding in the bucket of a backhoe

The employer was also cited for utilizing an electric pump in the presence of flamable materials.

 

One other-than-serious violation was cited for failing to report the fatality to OSHA within eight hours, as required by law.

 

Proposed penalties total $22,400. J.R. Resources has 15 business days from receipt of the citations to comply, request an informal conference with the OSHA area director in Erie, or contest the citations and proposed penalties before the independent Occupational Safety and Health Review Commission.
