The NJDEP Annual Site Remediation Reform Act Program Fee Calculation Report was recently released. Two categories of fees are impacted, the annual remediation fee, and remedial action permit-related fees. Most of the fees are increasing. However, the Remedial Action Permit (RAP) Annual Fees for soil and groundwater are actually decreasing substantially, down 50% to 75%!
Those persons who are actively remediating sites are charged annual remediation fees, and those persons who have implemented an institutional or engineering control remedy are charged one-time fees to process and modify RAPs, as well as, annual fees for the length of time the RAP is in place. The annual remediation fees cover the Department's costs to operate the SRRA program for active cases and have not changed since their original adoption in November 2009. These fees were the primary target for increases (see below link). Fees associated with remedial action permits fund the oversight of remedial actions implemented that require a Remedial Action Permit. The RAP fees were last adjusted in May 2012. The decrease in the annual RAP fees should help ease some of the financial burden when required to post Financial Assurance.
