OSHA Citation and Notification of Penalty

OSHA What should I do if I receive a citation from the Occupational Safety and Health Administration (OSHA)?

As an employer who has just received a citation, you have three options. The first option is to agree with the citation, correct the problem, and pay the penalty if it is proposed. The second option is to disagree and request an informal conference with the OSHA area director. The last option is to disagree and contest the citation. One very important fact is that you only have 15 working days from the date you receive the citation to either request an informal conference or contest the citation.

If you decide to agree with the citation you must notify the OSHA area director by letter, signed by a member of management that you have taken the appropriate corrective action within the time set forth in the citation and pay any penalties itemized. Employers needing to request an informal conference with an OSHA area director may do so to discuss the citation and notification of penalty. The following can be discussed at the informal conference:

  • Obtain a better explanation of the violations cited.
  • Obtain a complete understanding of the specific standards that apply.
  • Negotiate and enter into an informal settlement agreement.
  • Discuss ways to correct violations.
  • Discuss issues concerning proposed penalties.
  • Discuss proposed abatement dates.
  • Resolve disputed citations and penalties, (thereby eliminating the need for the formal procedures associated with litigation before the Occupational Safety and Health Review Commission)
  • Obtain answers to any other questions you may have.

Please note that an informal conference must be held within the 15 working day notice of intent to contest period and will neither extend the 15 working day contest period nor take the place of the filing of a written notice if you desire to contest. The last option for an employer is to contest the citation in writing, which must be done within 15 working days of the citation. If you wish to contest the citation, you must submit a Notice of Intent to Contest to the OSHA area director's office. Within this notice, the employer must clearly state what is being contested. OSHA will not consider a contest filed solely to avoid an employer's responsibility for abatement or payment of penalties. A proper contest of any item suspends your legal obligation to abate and pay until the item contested has been resolved. For more information please visit www.osha.gov.

The American Oil & Gas Historical Society is a non-profit organization that was founded in June 2003 by journalist Bruce Wells. He says, "Community museums, historical societies, and other organizations not only preserve a remarkable history, they serve as ambassadors to an often skeptical public." Wells researches and documents the history of the oil and gas industry to raise awareness and increase energy education through his website, www.aoghs.org
