VAT has been subject to the 'new' penalties regime since April 2009. The aim of this regime was to encourage tax payers to take their VAT affairs seriously by penalising careless and deliberate errors. If an error occurs despite reasonable care being taken, then no penalty is due. This is a very subjective test and many businesses struggle to prove the steps taken, and that those steps constitute reasonable care.
HMRC have on occasion stated that the penalties are not viewed as an additional income stream for the department, but this does not seem to be the attitude adopted by all VAT officers.
