Date Change for Senate Environment & Energy Committee Hearing on DEP Coastal Zone Management Rule Changes

The Senate Environment & Energy Committee has rescheduled the hearing for Monday, August 18th at 10:00 AM in Trenton. Below is the meeting information:

The committee will meet to hear testimony from the public on the Department of Environmental Protection's proposal revising the Coastal Zone Management and Coastal Permit Program rules, published in the New Jersey Register on June 2, 2014.  Rescheduled from 8/11/2014


As previously reported, the MTA/NJ strongly supports the adoption of these rules. Unfortunately, there continues to be strong opposition, which is likely the reason this hearing is being held. There is no resolution or legislation being proposed. This is only a hearing. 

 

MTA/NJ President, Fred Brueggemann will be testifying at this hearing and it is imperative that other marina owners and members are there in support.  The opposition to the marina rules is primarily regarding marina expansion and new development in shellfish areas and the dredged material management.

Background on Proposed Rule Changes: 

The proposal consolidates the Coastal Zone Management rules and Coastal Permit Program rules to streamline and align them more seamlessly with other DEP land-use permitting processes.

 

Highlights of the proposal include: 

  • Simplifying the permitting process for minor dredging projects and encouraging the beneficial use of dredge material;
  • Providing greater flexibility to construct new or expand existing marinas in certain circumstances and allowing the construction of restaurants at existing marinas;
  • Repealing the marina development rules that set design standards that greatly impeded a marina's ability to redevelop or expand;
  • Modifying several existing general permits to expand their scope and/or add flexibility.
