Food Companies Face Increased Odds of Litigation
If people get sick from food products related to your company, civil and criminal liability are a possibility. Even labeling claims can generate a lawsuit.
According to the Food Liability Law Blog, "For the past few years, there has been a steady, if not increasing, stream of class action lawsuits filed against various food and beverage manufacturers and retailers alleging misbranding and false advertising due to the presence of "All Natural" claims. The companies sued in these cases range from major manufacturers and retailers to small private label suppliers. Typically, these consumer class actions typically allege that the products are falsely marketed as "natural" because they contain synthetic, artificial or processed ingredients. Products that bear an "All Natural" claim but contain ingredients anywhere from ascorbic acid (vitamin C) to zinc oxide have been challenged on false advertising grounds." Let's face it, law schools keep graduating more and more attorneys that need to make a living. In the past, attorneys have targeted industries like real estate as growth markets. Because of the FSMA, companies in the food industry have now come under their spotlight. Essential to mitigating damages from lawsuits (and criminal proceedings) is the ability to demonstrate compliance with accepted international food safety standards, like those benchmarked by the Global Food Safety Initiative (GFSI). Not only do these standards promote detailed record keeping which is critical to mounting a defense, they also include verification of product recall procedures.
